The rules and regulations set forth in this chapter shall apply with
respect to the speed and operation of vessels upon any waters or waterways
situated within the territorial limits of the Village, including Hewlett Bay,
Macy Channel, Mallow Reach, Auerbach Canal, Lake Kathellen and Thixton Creek,
except when prohibited by the laws of the United States.
All provisions of the Navigation Law of the State of New York, all the
inland rules enacted by Congress and governing the navigation of the inland
waters of the United States and all the pilot rules for the United States
inland waters applicable to the waters of the Village, relative to the rules
for vessels passing each other, as to lights on vessels and other matters
consistent with the proper use of said named waters, shall be complied with
by all vessels navigating said waters.
As used in this chapter, the following terms shall have the meanings
indicated:
VESSEL
A powerboat, sailboat, scow, barge, canoe or rowboat and every description
of watercraft or other contrivance used on or capable of being used as a means
of transportation in water or in air.
Discharging of toilets from vessels is hereby prohibited.
The dumping of oil, refuse, garbage or waste in any waters is hereby
prohibited.
Vessels shall not moor or anchor except at the edge of the channel,
and in no case shall vessels moor in such a way as to interfere with the full
use of the channel.
For the purpose of §§
13-7 and
13-8 of this chapter, the Mayor and Acting Mayor are hereby designated as officers and agents of the Village and authorized for the purposes stated.
No vessel shall be operated at a greater speed than four miles per hour
in Thixton Creek, Macy Channel, Auerbach Canal, Mallow Reach or Lake Kathellen,
or at a greater speed than 12 miles per hour elsewhere.
No person shall operate a vessel propelled wholly or partially by an
engine operated by the explosion of gas, gasoline, naptha, kerosene or other
substance without having the exhaust from the engine run through a muffler
so constructed and used as to muffle the noise of the exhaust in a reasonable
manner.
Any person owning, operating or in charge of any vessel which violates or on which any violation of any of the provisions of this chapter shall occur or who assists in or permits a violation to occur shall be punishable as provided in §
1-15 of this Code.
