No person or persons, association of persons or corporation shall keep or maintain swine, sheep, cattle, poultry or fowl of any kind, pigeons, rabbits, hares or guinea pigs within the Borough of Rutherford.
The provisions of § 89-21 of this article shall not apply to the following:
A. 
The harboring indoors of poultry, fowl, rabbits or guinea pigs as household pets or for sale as household pets.
B. 
The keeping of any of said animals, poultry or fowl by a school or university under laboratory control.
C. 
The continuance of a license heretofore issued for the keeping of pigeons at the location therein stated or any renewals thereof; provided, however, that the house, coop or runway for said pigeons shall be at least 75 feet from a building containing a residence for a human being, and provided further that said license be renewed on or before December 31 of each year upon written application for the same being made to the Board of Health and upon payment of a fee of $5 to said Board of Health for each said renewal of said license.
The license provided for in § 89-22 of this article may be revoked by the Board of Health for any violation of this article after public hearing on the complaint is afforded to the holder of any such license.
The provisions of this article shall not apply to marketmen or persons dealing in live poultry, but in every such case a special permit shall be required, which permit shall be granted under such conditions and restrictions as the said Board may deem necessary for the protection of the public health.
This article shall take effect 30 days after the date of the first publication thereof.
