A Borough Planning Commission composed of five members, appointed in the manner provided by law, is hereby created and established in and for the Borough of Waynesboro. The said Borough Planning Commission shall exercise all the powers and perform all the duties vested by law in planning agencies for boroughs, subject to the authority of the Borough, by ordinance, to create a Borough Planning Department in the future and to allocate such powers and duties between the said Commission and the said Department. Provided, the persons constituting the Borough Planning Commission now functioning in the Borough, as created by Ordinance No. 523, shall constitute the Planning Commission hereby created and established, and nothing in this chapter shall affect the tenure of any member of the present Planning Commission, but all vacancies occurring on the present Planning Commission regardless of the cause and/or reason thereof shall not be filled until the Planning Commission is composed of five members. Thereafter, any vacancy occurring for any cause and/or reason thereof shall be filled in accordance with the provisions of the applicable law governing planning agencies in boroughs in effect at the time of the occurrence of such vacancy.
