No person or persons, partnership, firm or corporation shall keep any pig or hog at any place within the Borough of Waynesboro, or build or maintain any pig pen or hog pen at any place within the Borough, under penalty, for each and every such violation, upon conviction thereof, of a fine of not less than $5 nor more than $50 and costs of prosecution, and, in default of payment of such fine and costs, imprisonment for not more than 10 days. Provided, each day's violation of any provision of this article shall constitute a separate offense.

The provisions of § 96-1 of this article shall not apply to the keeping of a single pig, hog, or other swine by a person or persons or other entity as a pet where the pig or hog is kept in or around the keeper's dwelling or surrounding yard and is kept under control at all times by the keeper. Said pig shall not be permitted to run at large upon the public streets of the Borough except when being exercised and controlled by a leash or other restraint. Furthermore, the keeper of any such pet, pig or hog shall maintain the animal in a clean and sanitary fashion and shall not permit the accumulation of excrement or other debris in a manner which would become offensive to any person or persons outside the confines of the keeper's premises or which would pose or create a health hazard.
