This chapter is enacted pursuant to the provisions of Section 7-194, as amended, of the Connecticut General Statutes.
The following definitions shall apply for the purposes of this chapter:
DIRECTOR OF HEALTH
The Director of Health of the Town of Tolland or his or her authorized agent.
MODIFY
To make any changes in.
PUBLIC POOLS
An artificial basin constructed of concrete, steel, fiberglass or other relatively impervious material intended for recreational bathing, swimming, diving or therapeutic purpose which is located either indoors or outdoors and is provided with a controlled water supply and which is not used or intended to be used as a pool located at a single-family residence, which is used or intended to be used for commercial or business purposes.

REPAIR OF WATER SUPPLY WELL
Any work involved in the reaming, sealing, installing, changing of casing depths, perforating, screening, cleaning, acidizing or other redevelopment of a well.
SEPTIC TANK CLEANER
A person engaged in the business of cleaning septic tanks as a means of livelihood.
SOIL TESTING
Deep pits and percolation tests.
WATER SUPPLY WELL
An artificial excavation or opening in the ground by which groundwater can be obtained or through which it flows under natural pressure or is artificially withdrawn.
No person, firm or corporation shall construct, reconstruct, extend, modify or repair any subsurface sewage disposal system or water supply well within the Town of Tolland without first obtaining a permit for such work from the Director of Health.
A. 
Subsurface sewage disposal system.
(1) 
Construction or repair of any subsurface sewage disposal system in the Town of Tolland shall be done by a State of Connecticut licensed subsurface sewage disposal system installer or the homeowner in residence.
(2) 
No permit to construct, reconstruct, extend, modify or repair any subsurface sewage disposal system in the Town of Tolland shall be issued until soil testing witnessed by the Director of Health has been conducted or unless the necessity for such soil testing has been waived by the Director of Health.
(3) 
Application for permit for work on a new subsurface sewage disposal system shall be accompanied by a plan prepared by a registered professional engineer licensed to practice in the State of Connecticut. The plan must be drawn to scale using one inch equals 20 feet and show the proposed sewage disposal system; existing or proposed dwellings or structures; existing or proposed water service lines and wells; location of adjacent property lines, wetlands or watercourses; basis of design; ground- and surface water drains; and any other information deemed necessary by the Director of Health to assure compliance with state and local regulations. Such plans shall also include spot elevations; location of test holes and percolation test(s); existing and proposed ground contours; building locations and elevation; elevation of ledge and seasonal high groundwater table; suitable elevation benchmark; elevations of all septic system components; location and elevation of any necessary drainage facilities and watercourses; a cross-section view of the proposed leaching systems; and any other information necessary for the proper construction of the subsurface sewage disposal system.

B. 
Water supply wells.
(1) 
Construction or repair of any water supply well in the Town of Tolland shall be done by a State of Connecticut licensed well driller.
(2) 
This chapter shall not require a person who constructs a well on his own or leased property, intended for use only for farming purposes on his farm, to obtain a certificate of registration or a permit.
C. 
Public pools. No permit to construct a public pool in the Town of Tolland shall be issued until a plan is prepared by a registered professional engineer licensed to practice in the State of Connecticut. The plan must be drawn to a scale of one inch equals 20 feet and include all of the requirements set forth in § 19-13-B-33b of the Public Health Code of the State of Connecticut.

All applications for a permit applicable to sewage disposal systems and water supply wells shall be filed with the Director of Health on forms provided by the Director of Health. The Council shall, by resolution, adopt a fee schedule as deemed appropriate.[1]

The owner of any property within the Town of Tolland or said owner's authorized agent may request the Director of Health to supervise and inspect on-site soil tests on such property, even though an application for a permit has not been filed with the Director of Health concerning such property as provided herein. The fee for this service shall be as listed in § 124-4 above.

A. 
Any person, firm or corporation who violates any section of this chapter shall, upon conviction, be punishable by a fine not to exceed $90.
B. 
Any person, firm or corporation who violates any sewage disposal system or any water supply well which has been constructed, reconstructed, extended, modified or repaired without a permit as required by this chapter shall, upon conviction, be punishable by a fine not to exceed $90 for each and every day that such violation continues; provided, however, that such person, firm or corporation has been notified, in writing, by the Director of Health that the use of such system or well is in violation of this chapter.
Any permit issued pursuant to the provisions of this chapter shall expire one year after the date that such permit is issued, and unless all work has been completed on such sewage disposal system or on such water supply well within said period of time, a new application for a new permit or a renewal of said permit shall be required pursuant to the provisions of this chapter, in which case, the applicant shall comply with all regulations, ordinances and statutes of the State of Connecticut and the Town of Tolland in effect on the date when such new application is submitted for approval. There will be no charge for a renewal.
No septic tank cleaner shall remove the contents of any septic tank, cesspool, privy or other receptacle containing human excrement in the Town of Tolland until a permit to be renewed annually for such removal has been obtained from the Director of Health. The location of any and all disposal areas shall be approved by the Director of Health. Such cleaning is to be performed in accordance with the requirements of the Public Health Code of the State of Connecticut.
