Whenever any subdivision of land is proposed
to be made in any area subject to the jurisdiction of the Planning
Board with respect to the approval of subdivisions, and before any
contract for the sale of or any offer to sell such subdivision or
any part thereof is made, and before any permit for the erection of
a structure in such proposed subdivision shall be granted, the subdivider
or his or her duly authorized agent shall apply for approval of such
proposed subdivision in accordance with the following procedure, which
procedure includes the following steps for minor and major subdivisions:
A. For minor subdivisions:
(1) Informal discussion of sketch layout (Optional step, See §
245-6.)
(2) Approval, with or without modification, or disapproval of a minor subdivision plat. (See §
245-7.)
B. For major subdivisions:
(1) Informal discussion of sketch layout. (Optional step, See §
245-6.)
(2) Preliminary review of a subdivision; approval, with or without modification, or disapproval of preliminary plat. (See §
245-8.)
(3) Final review of a subdivision; approval, conditional approval with or without modifications or disapproval of final subdivision plat. (See §
245-9.)
At the option of the subdivider, the subdivider may present his/her plan to the Planning Board at a regularly scheduled meeting to discuss his/her concept for the subdivision plan, provided that the subdivider has met the minimum requirements for a submission of a sketch plan found in §
245-25. However, in some circumstances, the subdivider may want to provide more information to sufficiently illustrate his/her concept. The intention of the Board through this sketch review is to provide guidance to the developer at the early stages of the development of the plan, by evaluating the proposed plan in relation to objectives set forth in these regulations. Although the subdivider is not required to submit a sketch plan, he or she is strongly encouraged to participate in this part of the process. At the same meeting, the subdivider should also discuss with the Planning Board the requirements for street improvements, drainage, sewerage, water supply, fire protection and similar aspects, as well as the availability of existing services.
