Every owner, lessee or occupant of lands, or
any agent, servant, representative or employee of any such owner,
lessee or occupant of land, shall not throw, cast, deposit or cause
to be thrown, cast or deposited, or suffer or allow to be placed upon
or remain on any such land, any rubbish, waste materials, litter,
leaves or garbage or any other materials which may constitute a hazard
to health or which may be combustible or flammable or which may constitute
a fire hazard.
The Village Clerk may serve or cause to be served
written notice, either personally or by certified or registered mail
upon the owner or owners of such land wherein a violation of this
article is alleged to exist, indicating the nature of the alleged
violation of this article and requiring the owner or owners to comply
in removing such violation within 10 days after the notice is served.
If the owner or owners upon whom such notice
is served fails, neglects or refuses to comply with such notice, the
officers, agents and employees of the Incorporated Village of Hewlett
Harbor are hereby authorized to enter upon such land and to do whatever
work is necessary to remove the said violation.
After the work is completed, the Superintendent
of Public Works shall certify, to the Board of Trustees, the Assessor
and the Treasurer, the cost of performing such work, and the said
cost shall thereupon be assessed upon the said real property upon
which the said violation existed and shall constitute a lien and charge
upon the real property on which the assessment is levied until paid
or otherwise discharged or satisfied and shall be collected by the
Village Treasurer, all as set forth in Article 5, entitled Finances,
of the Village Law of the State of New York.
If any owner of such lands is a nonresident
of the Village, a notice mailed to his last known address shall be
deemed sufficient service thereof.

branches, leaves or garbage or any other materials which may constitute
a hazard to health, or which may be or become combustible or flammable
or which may constitute a fire hazard or may prevent access to Village-owned
property.
B. The violation of any provision of this section is
punishable by a fine not exceeding the amount of $1,000 per day for
each day the violation exists or imprisonment for a period not exceeding
15 days, or both such fine and imprisonment. A new appearance ticket
may be issued each day that the offender(s) is/are in violation.
