A. 
This chapter shall govern the terms of employment of all employees of the Borough government of the Borough of Dumont.
B. 
Nondiscrimination. The Borough of Dumont values diversity among its employees, which enriches our Borough and fosters creativity. The Borough of Dumont is also committed to ensuring that the work environment is free from discrimination based on race, gender, age, religion, national origin, sexual orientation, marital status, disability, or any other factor that is unrelated to a person's qualifications for the job.
C. 
Anti-harassment including sexual harassment. The Borough of Dumont will not tolerate intimidation or harassment based on any of these factors. Harassment includes unwelcome sexual advances, uninvited suggestive remarks, or sexist, racist or religious slurs, and ethnic jokes, if it interferes with an employee's work performance or creates an intimidating, hostile, or offensive work environment. If an employee believes they are the victim of employment discrimination or harassment, he or she must contact the Borough Administrator's Office immediately.
Pursuant to the laws of the State of New Jersey, and subject to such laws, the provisions hereof may be changed or modified by, and shall be deemed changed or modified to the extent necessary to conform to, the provisions of any collective negotiation agreement approved by resolution of the Borough Council and executed pursuant to such resolution. However, all salary changes shall be implemented through the adoption of an ordinance.
Subject to the provisions hereof, the Borough Council may, by resolution, supplement and implement the provisions hereof and establish additional policies governing employment by the Borough of Dumont. The Borough Administrator shall implement the provisions hereof, consistent with § 69-5 hereof.
A. 
The power to hire employees of the Borough of Dumont and the power to terminate the employment of such employees shall be vested in the Borough of Dumont, provided that the Borough Administrator and Mayor and Council shall be consulted regarding the hiring of or the termination of any employee.
B. 
Subject to the provisions of any applicable collective negotiation agreement, prior to the hiring of any employee to fill any position, such position shall be advertised as available, on at least one occasion, in the official Borough newspapers.
C. 
Each person applying for a Borough of Dumont position shall complete a written, standardized employment application. All questions on said application including, but not limited to, criminal history shall be truthfully filled out. Any non-truthful response on the employment application will be just cause for the applicant to be denied employment. Further, if an employee is found to have improperly filled out an application for employment, his/her employment with the Borough of Dumont shall be terminated.
Subject to the provisions of this chapter and any other standard policies which may be established by the Borough Council, the Borough Administrator shall establish and issue directives, rules, orders, and policies governing employment by the Borough government and the conduct, actions, and procedures to be followed by Borough employees, and it shall be the duty of the Borough Administrator to implement the policies hereby established and any other standard personnel policies established by the Borough Council.
The Central Personnel Office is to be operated under the supervision of the Borough Administrator.
The Central Personnel Office shall have and perform the following duties and responsibilities, together with such other duties and responsibilities as shall be prescribed by the Borough Council, all of which are to be performed and fulfilled in accordance with standard personnel policies.
A. 
Establishment and maintenance of personnel records of Borough employees.
B. 
Administration of the Borough's personnel policies and administration of collective negotiation agreements covering Borough employees.
C. 
Recruitment of personnel and establishment of criteria for employment by the Borough and criteria for the filling of positions within the employ of the Borough.
D. 
Advising the Borough Council and the Borough Administrator respecting personnel matters.
E. 
Assisting such person as shall be designated by the Borough Administrator to conduct collective negotiations, and assembling and providing necessary data and information for use in such negotiations.
F. 
Reviewing and recommending changes and modifications, where necessary or advisable, in the classification plan for Borough employees.
No person shall be hired for a permanent position within the employ of the Borough unless such person shall first have been medically examined by the Borough physician, or such other physician as shall be designated by the Borough Administrator and unless such physician shall advise that such person is physically and medically qualified for the capable of fulfilling the duties of such position.
