No site or structure shall be erected and no
existing structure shall be moved, altered or enlarged except in conformity
with the regulations for the district in which the site, structure
or use is located. Where this chapter imposes greater restrictions
than those imposed or required by other rules or regulations or ordinances,
the provisions of this chapter shall control.
The districts established by this chapter, and
subject to future amendments, shall be as follows:

The boundaries for each district listed as part
of this chapter are the boundaries indicated for the district by the
map entitled "Official Zoning Map of the Town of Gates," dated with
the effective date of this chapter, which map is hereby adopted by
reference and declared to be part of this chapter, and hereinafter
known as the "Zoning Map."
There shall exist only one Official Zoning Map,
which shall be kept in the office of the Town Clerk; and it shall
bear the seal of the Town of Gates, a certification that it is the
Official Zoning Map of the Town of Gates and its date of adoption.
The original map shall be on file with the Town Clerk and open to
review by the general public. Should the Zoning Map become damaged,
destroyed, lost or difficult to interpret because of the changes and
additions, the Town Board may by resolution adopt a new Zoning Map
to supersede the former map. The new Zoning Map shall bear a statement
which explains that it supersedes the prior map and gives the dates
of adoption of both the prior map and the new Zoning Map. The records
of the ordinance amendments and map adoption and, if possible, the
prior map shall be preserved.
In making a determination, where uncertainty
exists, as to boundaries of any of the aforesaid districts as shown
on said Zoning Map, the following rules shall apply:
A. Where district boundaries are indicated as approximately
following the center line or right-of-way lines of streets, alleys,
highways, railroads or streams, such lines shall be construed to be
such district boundaries.
B. Where district boundaries are indicated as approximately
following lot lines, such lot lines shall be construed to be said
boundaries. If a district boundary divides a lot into two or more
districts, the entire lot shall be placed in the district in which
the lot would be most compatible, based on an evaluation of its characteristics
and recommendation by the Planning Board to the Town Board.
C. Where district boundaries are not indicated as approximately following the items listed in Subsections
A and
B above, the boundary line shall be determined by use of the scale designated on the Zoning Map.
D. Whenever any street, alley or other public way is
vacated in the manner authorized by law, the zoning district adjoining
each side of such street, alley or public way shall be automatically
extended to the center of the former right-of-way and all of the area
included in the vacancy shall then and henceforth be subject to all
regulations of the extended districts. In the event that none of the
above rules is applicable, the location of such boundary, unless the
same is indicated by dimension on the map, shall be determined by
the Town Board upon recommendation of the Planning Board.
