The Council of the Borough of Tarentum hereby enacts and imposes a curfew within the Borough of Tarentum.
The specifics of the curfew are as follows:
A. 
No minor under the age of 16 years shall be or remain in or upon any street, alley, park or public place after 10:00 p.m., unless such person is accompanied by any parent, guardian or other person having the legal custody of such minor or unless such minor complies with one of the exceptions hereinafter outlined in § 102-3.
B. 
No person of age 16 years or 17 years shall be or remain in or upon any street, alley, park or public place after 12:00 midnight, unless such minor is accompanied by any parent, guardian or other person having the legal custody of such minor or unless such minor complies with one of the exceptions hereinafter outlined in § 102-3.
A minor shall not be in violation of this chapter if said minor is en route to or returning from a place of employment or is acting under emergency circumstances.
Any minor in violation of § 102-2 of this chapter shall be taken into custody by the borough police and detained pending notification of his or her parent, guardian or person having the legal custody of such minor.
The borough police officers are hereby empowered, when taking such minors into custody, to use their discretion in determining age, and in those instances where positive identification and proof of age are not furnished, the officer's judgment shall prevail.
Any parent, guardian or person having the legal custody of a minor who violates § 102-2 of this chapter shall be issued a warning for a first offense, shall be fined $100 for a second offense and shall be fined $300 and be imprisoned for not more than 10 days for each offense after the second offense.
