Definitions are given as examples and are not limited whenever
used in this chapter. Unless otherwise expressly stated, the following
words shall have the meanings hereinafter set forth:
Any private business operation generating waste within the
allowable limits as set forth in this chapter.
The right-of-way between the street and property line.
The Oneida-Herkimer Waste Authority.
Auto batteries in a sealed, nonleaking state with caps attached.
Tires with a rim diameter less than 17 inches, demounted
from the rim only.
Mattresses, stuffed furniture, clothing, rugs and padding,
junk, televisions and stereos.
The person(s) appointed by the Village Board who oversees
and enforces the local laws of the Village.
Lumber, plastics, asphalt shingles, tiles, sheetrock, wood
siding and storm windows.
Grass clippings, leaves, garden organics and branches (under
12 inches in diameter); excluded are large tree trunks, stumps or
branches over 12 inches in diameter.
Concrete, stones, dirt and sod.
Putrescible solid waste (including animal and vegetable waste)
originating primarily in home kitchens. Also included is litter, junk
mail, clothes, empty aerosol cans and empty, dry paint cans.
A metal or plastic can no larger than 40 gallons or heavy
duty plastic bags.
Pesticides, herbicides and residues, oil-based paint and
thinners and all products harmful to humans and the environment. These
items will not be collected by the Village.
A one-family unit, its members living independently of each
other.
A private business permitted by the Authority to remove waste
not in conformity or not collected by Village ordinance or that which
a resident wishes to have removed privately or contractor debris.
All material deemed recyclable by the Oneida-Herkimer Solid
Waste Management Authority.
Stoves, washers, watertanks, refrigerators with doors removed,
metal ducts, radiators, metal doors, siding, tire rims, mowers, iron,
tubs and sinks.
Includes but is not limited to infectious, hazardous, industrial
and commercial waste as defined in 6 NYCRR Part 360, as amended, and
which will not be collected by Village.
Used motor oil in liquidtight containers, undiluted with
any other substances.
The Village of New Hartford.
Used to generalize all material collected by the Village.
The intent of this chapter is to provide the most economical
and just method for the disposal of waste within the Village of New
Hartford and to safeguard the public health and safety and general
welfare of the community.
The Board of Trustees of the Village shall be empowered and
authorized to regulate and implement this chapter concerning such
matters as frequency of collection, fees and all other matters relating
to the storage, collection and disposal of waste, provided that such
regulations are in conformity with all other governing agencies' requirements.
Waste within the allowable limits will be collected by the Village
Department of Public Works or a designee appointed by the Village
Board.
Roll-off container rental fees will be billed directly at the
time of use. Payment for this service will be due 30 days from receipt
of the invoice. Nonpayment for this service will be added to the annual
Village tax levy of the premises. If the invoice is not paid within
30 days, interest at 2% a month will be added after 30 days.
A.
Any owner responsible for waste that is not acceptable for Village
collection shall make suitable arrangements for the collection and
disposal of such waste.
B.
No household, commercial or building waste shall be stored or accumulated
for a period of more than 30 days on any premises within the Village,
except as permitted by this chapter.
C.
No person shall place, deposit or store any waste on or in any street,
thoroughfare, sidewalk drain, ditch or watercourse or any other public
place within the Village.
D.
The owner of any parcel within the Village will be ultimately responsible
for waste generated from that parcel.
E.
In the event of a violation of any provision of this section which,
in the opinion of the Code Enforcement Officer or the Board of Trustees,
shall be hazardous to the health, safety or well-being of the community
will be served notice of violation, directing removal of the violation
from the premises within 72 hours from receipt of the notice. In the
event that material is not removed, the Village, through its employees,
may enter upon the premises, remove said waste and charge the entire
cost of removal against the owner, and said charge will be a lien
upon the premises.
A.
From the time of placement of waste for collection, such waste shall
be Village property. It shall be unlawful for any person to collect
or cause to be collected any such material without the express written
authorization of the Village.
B.
Nothing herein shall prevent any persons from making arrangements
for the removal of waste from their property by a private contractor.
Any business or firm performing work for an owner shall be responsible
for the removal of all waste generated from that premises.
A.
Small businesses generating one cubic yard of uncompacted waste or
less per collection and which conforms to all requirements of this
chapter as to acceptable quantity, type and containment will be collected
by Village employees.
B.
All businesses, schools and apartment buildings generating more than
the allowable limits of the Village collection, one cubic yard not
compacted, and which use a private garbage contractor for removal
of waste shall also be responsible for the collection of all recyclables.
No person shall dump or deposit any waste originating outside
of the Village whatsoever on any Village property, right-of-way or
dropoff center.
No person, business owner or employee shall place in a public
waste receptacle maintained by the Village any waste that originates
from a residence or the operation of a place of business.
Any person delivering waste to the Village dropoff site must
present the operator of the site with a valid driver's license as
proof of residency or official proof of residency such as a tax bill,
etc.
The collection of the Village's waste shall be referred to and
collected separately as follows:
A.
Household garbage shall be collected on a schedule set by the Village
Board.
B.
Recyclables shall be collected on a schedule set by the Village Board.
C.
Green waste. Collection of these wastes shall be collected on a schedule
set by the Village Board.
D.
Construction and demolition debris, bulky waste, white goods, auto
tires and auto batteries shall be collected at curb on a schedule
set by the Village Board and may be delivered by a resident to the
Village Department of Public Works on a schedule set by the Village
Board.
E.
Hardfill, as defined, shall be collected on a schedule set by the
Village Board.
Used motor oil, as defined, may be disposed of by residents
at the Authority or private redemption centers or the Village DPW
on a schedule set by the Village Board.
A.
Household hazardous waste. Household hazardous waste, as defined,
may be disposed of at the Authority per its schedule and allowable
limits.
B.
Special waste. Infectious waste, industrial waste and commercial
waste, as defined, will not be collected by Village employees. Arrangements
for the removal of such waste shall be obtained at the generator's
expense from a private contractor which has all mandated permits.
Any fuel storage tank, drum, explosives or ammunition or any other
hazardous items will not be collected by the Village.
A.
No container of any kind or any bundle of any waste set out for collection
will have a weight greater than 50 pounds.
B.
No barrel used as a container will be greater than 40 gallons.
C.
No paper bags or corrugated cardboard will be collected as a container.
D.
Households will be responsible for maintaining containers in proper
order, in good condition and free from odor.
E.
Containers that became a hazard to the collector due to breakage,
rust or auto collision may be removed from service by the collector
and an explanation tag will be left at premises.
H.
Branches or sticks must be bundled with heavy twine or rope suitable
for lifting.
K.
Bulky waste.
(1)
Bulky waste at the curb shall be contained. Rugs, padding and mattresses
must be rolled and tied with rope, no larger than five feet long and
weighing not more than 50 pounds.
(2)
Televisions, stereos and items of this nature that are too large
to contain may be set out loose with bulky waste category.
L.
White goods and all metal products. Appliances shall have doors removed
prior to placement at curb. Metals such as pipe and swing sets shall
be broken down and have a maximum length of 10 feet. No more than
two items will be picked up per collection.
M.
Automotive tires. All tires shall be removed from the rim (wheel).
No tire shall have a rim diameter greater than 17 inches. No more
than four automotive tires will be accepted per collection. Tires
that are larger than accepted by the Village may be disposed of at
the Oneida-Herkimer Waste Management Facility for a fee.
N.
Automotive batteries. No more than two batteries will be accepted
per collection. All batteries must be intact and have caps firmly
in place in order to prevent injury due to acid leakage. Batteries
may also be disposed of at scrap dealers of redeemed batteries for
credit against the purchase of a new battery.
A.
Upon three days' prior notice, the Village DPW, at its option, may
supply an open-top container, to be filled by the resident per DPW
rules and regulations, which may be delivered to a resident's premises.
B.
Village vehicles required to enter private property for the collection
of materials will be at the sole risk of the property owner.
C.
A fee, reflecting the current disposal costs, will be charged for this service and be regulated by the Board of Trustees and meet the requirements for payment as set forth in the § 96-5 of this chapter.
D.
This service will have a limit of two containers per month per premises.
E.
With the exception of auto batteries, tires and any recyclable material, all waste listed in § 96-13 of this chapter may be disposed of but shall be separated as listed in their respective categories to minimize disposal costs to the resident. In the event that material is not separated, the maximum disposal fee will be charged to the resident.
