It shall be unlawful for any child under the age of 16 years of age to loiter or be on the streets in the City of Kingston after the hour of 10:00 p.m. and before the hour of 6:00 a.m., unless such child be accompanied by its parents or guardian or other adult persons into whose care and custody said child has been committed by its parent or guardian, or whose employment makes it necessary to be upon said street or public way during the nighttime after and before said specified hours; provided however, that this exception shall not apply when the minor person shall be playing or unnecessarily loitering in or upon such street or public place; and provided, further, that, with respect to a minor whose employment makes it necessary to be upon said street or public place after and before said specified hours, this exception shall only apply during such time said minor is actually engaged in its employment or actually traveling between his place of employment and residence.
It shall be unlawful for any parent, guardian or other person having the legal care and custody of any person under 16 years of age to allow or permit any such child, ward or other person under such age, while in his legal custody, to go or be in or upon any of the streets, alleys, parks or public places in said City of Kingston after the hour above mentioned in § 191-1 of this chapter.
Any person violating any of the provisions of § 191-2 of this chapter shall be guilty of an offense, and on conviction shall be punished by a fine of $100 for each offense, or in lieu thereof, 25 days in jail.
Each member of the police force, while on duty, is hereby authorized to arrest, without warrant, any person willfully violating provisions of § 191-1 of this chapter and detain such person for a reasonable time in which complaint can be made and a warrant issued and served, but no child or minor person arrested under the provisions of this chapter shall be placed in confinement, other than being detained in some private room at police headquarters, until the parents, guardian or other person having legal control and custody of such child or minor person shall have been personally notified of such arrest and shall have refused to be held responsible for the observance of the provisions of § 191-1 of this chapter by such child or minor person.
This chapter shall take effect immediately.
