It shall be unlawful for any person, corporation, association or partnership to create, construct, allow or permit on premises owned by said person, corporation, association or partnership in a place accessible to children any open cistern, well or other excavation or opening containing water or other liquid, unattended or unguarded or without adequate fences or covers to prevent children from falling into said cisterns, wells or other excavations or openings.
Any person, corporation, association or partnership violating the provisions of § 211-1 hereof shall be deemed guilty of a misdemeanor, and shall, upon the first conviction, be fined in a sum not to exceed $50, and upon a conviction subsequent to a first conviction, shall be fined in a sum not to exceed $500 or imprisonment of not more than one year, or both such fine and imprisonment.
This chapter shall be published twice during the month of January in the official newspapers of the City of Kingston, and shall take effect the first day of February 1954.
