It shall be unlawful for any person, firm, corporation, transient merchant, church, club, charitable institution, hawker or peddler to vend, sell or dispose of or offer to vend, sell, dispose of or display, any goods, wares, merchandise, produce or vegetables on any public walk, street, alley or anywhere within the Borough without first registering with the Borough. Registration shall be on a form approved by the Borough Council and available from the Borough Manager/Secretary. When the Manager/Secretary has approved the issuance of a sidewalk sales license, the applicant shall be issued a license. The license shall contain the information required on the application and the expiration date, and one of the photographs which was submitted with the application shall be attached. The license shall be carried by the applicant at all times when engaged in sidewalk sales and shall be exhibited for inspection to any person approached for purposes of sidewalk sales.
A. 
The term of each sidewalk sale license shall be specified on the license which is issued and shall not exceed one week.
B. 
The license fee to be charged is $10 per day. No fee shall be charged to applicants who represent organizations which are charitable, religious or educational. Exemption from taxation by the United States Treasury Department to such organizations shall be sufficient for the exemption from payment of fees set forth in the section. However, tax-exempt determination is not necessary if such organization, in fact, meets the criteria set forth herein. Candidates for political office or their workers also are exempt from the payment of license fees.
A. 
Day of the week.
(1) 
Sundays. Sidewalk sales shall be permitted between the hours of 1:00 p.m. and 5:00 p.m. in commercial districts.
(2) 
Mondays through Saturdays. Sidewalk sales shall be permitted in commercial districts between the hours of 9:00 a.m. and 5:00 p.m.
B. 
Special requirements.
(1) 
No street or alley shall be blocked by any merchandise offered for sale.
(2) 
A four-foot passageway for pedestrians shall be left open, and merchandise shall be secured and adequately placed so that it will not endanger passersby or fall or extrude into any street or alley.
(3) 
Sales shall not be operated in any manner which would cause a nuisance or create a fire hazard.
(4) 
Litter shall be minimized during sales and removed in its entirety following the sidewalk sale.
