As used in this article, the following terms
shall have the meanings indicated:
OPERATOR
Every individual who shall operate a vehicle.
PARKING METER
A mechanical device located upon a public street or sidewalk
or public parking facility in a place designated by the article as
a parking meter zone, hereafter defined, which device shall record
a certain number of minutes by the use of a clock mechanism determining
the period of time for which parking privileges may be extended to
the person depositing a coin therein.
PARKING METER ZONE
An area designated by ordinance where a vehicle may be temporarily
parked and allowed to remain for the period of time indicated on the
meter.
POLICE OFFICER
Any employee of the Borough designated individually by job
description classification by the Chief of Police, Personnel Director
or the Borough Manager as having authority to enforce provisions of
this article, and any police officer of the Borough.
Parking meter zones shall be such as may from
time to time be established by ordinance.
A. It shall be unlawful to park any vehicle or to permit
a vehicle to remain parked in any parking meter zone for a period
longer than designated on such meter, between the hours designated
thereon, except on Sundays.
B. It shall be unlawful to park any vehicle in any such
parking meter zone without paying the fee designated or to permit
such vehicle to remain for a longer period than that covered by the
amount paid.
Parking meters shall be installed in the parking
meter zones as established and provided for by ordinance and shall
be placed upon the curb immediately adjacent to the individual parking
places hereinafter described. Each parking meter shall be placed or
set in such a manner as to show or display by a signal whether or
not the parking space adjacent to such meter is legally in use.
The Chief of Police shall have markings painted
or placed upon the curb of the street adjacent to each parking meter
for the purpose of designating the parking space and the angle at
which vehicles are to be parked to the curb. Each vehicle parking
within any parking meter zone shall park within the line or markings
so established. It shall be unlawful to park any vehicle across any
such line or marking or to park said vehicle in such position that
the same shall not be entirely within the area designated by such
lines or markings.
Any person desiring to park any vehicle within
such parking meter space shall deposit the proper coins for the time
desired, as posted on said meter.
It shall be unlawful for any person not authorized
by the Borough to deface, injure, tamper with, open or willfully break,
destroy or impair the usefulness of any parking meter installed under
the provisions of this article.
Parking meters shall be installed in each of
the parking meter zones established by this article. The Borough Manager
is hereby directed to provide recommendations for the purchase, leasing,
acquiring, installation, operation, maintenance, supervision and use
of such meters. The Borough shall enter into a contract, after approval
of the terms and conditions thereof by the Council, for such protection
and maintenance of the parking meters as may be necessary to maintain
the same in good operating condition.
Each parking meter installed in accord with
the provisions of this article shall be placed upon the curb immediately
adjacent to an individual parking space or adjoining public parking
lot areas.
Each parking meter shall be placed or set in
such manner as to show or display by a signal that the parking space
adjacent to such meter is or is not legally in use. Each parking meter
installed shall indicate by a proper legend the days and times the
parking meter charges are in effect and the charge therefor and, when
operated, shall indicate on and by its dial and pointer or other device
the duration of the period of legal parking, and, on the expiration
of such period, shall indicate illegal or over parking.
The Borough Council shall have lines or markings
painted or placed upon the curb or upon the street adjacent to each
parking meter or on each lot for the purpose of designating the parking
space for which the meter is to be used, and each vehicle parking
adjacent or next to any parking meter shall park within the lines
or markings so established. It shall be unlawful and a violation of
this article to park any vehicle across any such line or marking or
to park a vehicle in such position that the same shall not be entirely
within the area so designated by such lines or markings.
Except as provided by this article, when any
vehicle is parked in any space adjacent to which a parking meter is
located in accordance with the provisions of this article, the operator
of the vehicle shall, upon entering the space, immediately deposit
or cause to be deposited the charges in United States coins in such
parking meter and put such meter in operation, and failure to deposit
such coin and put the meter in operation shall constitute a violation
of this article; provided, however, that no charge for the use of
a parking meter space shall be made between 6:00 p.m. and 9:00 a.m.
during weekdays, and no charge shall be made on Sundays; and provided
further that persons operating commercial vehicles shall not be required
to place a coin in a parking meter while occupying a parking space
during the time necessary for the loading or the unloading of such
commercial vehicle.
Upon the deposit of the charges and placing
a parking meter in operation, as required by the preceding section,
the parking space may be lawfully occupied by the vehicle during the
period of parking time which has been prescribed for the part of the
street in which the space is located.
The charges required to be deposited in parking meters are hereby levied and assessed as fees to provide for the proper regulating and control of traffic and parking upon the public streets, for the cost of supervision and regulating the parking of vehicles in the parking meter zones created in this article and to cover the cost of purchasing, leasing, acquiring, installation, operation, maintenance, supervision, regulation and control of the parking meters. The meter locations and parking meter charges shall be as stated in Schedule XX (§
191-85), attached to and made a part of this chapter.
If any vehicle remains parked in any parking
meter space beyond the parking time fixed for such space, the parking
meter shall, by its dial and pointer or other device, indicate such
illegal parking, and in that event such vehicle shall be considered
as parked overtime in violation of this article. It shall be unlawful
for any person to cause, allow, permit or suffer any vehicle registered
in the name of or operated by such person to be parked overtime or
beyond the period of legal parking time established for any parking
meter zone.
It shall be unlawful for any person to deposit
or cause to be deposited in any parking meter any slug, device or
metallic substance or any other substitute for a coin of the United
States.
It shall be the duty of police officers of the
Borough to report:
A. The number of each parking meter which indicates that
the vehicle occupying the parking space adjacent thereto is or has
been parked in violation of any of the provisions of this article.
B. The state license number of such vehicle.
C. The time when such vehicle was parked in violation
of any of the provisions of this article.
D. Any other facts, a knowledge of which is necessary
to a thorough understanding of the circumstances attending such violation.
At the time of any parade for which a parade
permit has been issued, the Chief of Police shall cause covers or
hoods to be placed over each parking meter along the parade route.
Such cover shall say "No parking today. Parade route."
The Chief of Police, under the direction of
the Mayor or the Borough Manager, may temporarily have hoods placed
over specific parking meters to accommodate funerals, heavy loading
and unloading operations and other special needs or emergencies. It
shall be unlawful and a violation of this article for any person to
park a vehicle or to allow a vehicle to remain parked in a parking
space adjacent to a hooded meter.
A police officer finding a vehicle parked in
violation of this article shall attach to such vehicle a notice to
the owner or operator thereof that such vehicle has been parked in
violation of a provision of this article and instructing such owner
or operator to report and pay the amount of penalty voluntarily or
to appear in court at a time and date stated.
A. Any person violating the provisions of §
191-36, relating to tampering with meters, or §
191-45, relating to the deposit of slugs, shall be fined $100 and, in addition, will be required to pay the amount required to repair the meter.
B. Any person violating §§
191-32,
191-40,
191-41,
191-44 or
191-48 shall be fined $15 for each offense. Any offense will be deemed to have occurred when a vehicle is in a parking space adjacent to any parking meter while the meter is displaying a signal indicating that the vehicle has parked beyond the period of time prescribed for such space. Additionally, if the vehicle remains in that space with an expired meter for more than the maximum time allowed by the meter, then an additional offense will have occurred.
