The purpose of this district is to create a mixed use area that consists of pedestrian-oriented retail, service, and office uses to serve both regional and neighborhood customers and apartments above the street-level commercial uses. Uses having greater impacts are permitted by conditional use permit.
Land, buildings, or premises shall be used by right for only one or more of the following uses:
A. 
Retail store, including general merchandise, hardware, department or variety store, clothing store, gift shop, bookstore, or pharmacy.
B. 
Food store, including grocery store, bakery, confectionery, and convenience store where goods are sold at retail.
C. 
Personal service shop, including barbershop, beautician, shoe repair, tailor, fitness salon or spa, laundry/laundromat, or similar service establishment.
D. 
Eating or drinking establishment, including standard eat-in restaurant, pizza shop, delicatessen, or similar use and take-out establishment, but excluding drive-through establishment.
E. 
Bank or other financial institution.
F. 
Theater.
G. 
Apartment, provided that it is located on the second or third floor.
H. 
Municipal building, library, or similar municipal or public use, except high impact public uses such as storage or repair of municipal trucks or other heavy equipment.
I. 
Park, plaza, or similar recreational area or meeting place.
J. 
Office or office building.
K. 
Medical or dental office or physical therapy clinic.
L. 
Private club, subject to § 196-122.
The following shall be permitted as conditional uses only, subject to the applicable provisions of Article XVIII, Procedure and Standards for Conditional Uses:
A. 
Child day-care center, subject to § 196-137.
B. 
Video game arcade.
C. 
Any use of the same general character as those permitted in §§ 196-34 and 196-35. Such use shall be permitted by Borough Council upon the recommendation of the Planning Commission, shall be consistent with the purposes of the district, comply with the performance standards in Article XX, and not be detrimental to the surrounding neighborhood. To determine if a proposed use is of the same general character as any of the listed permitted uses, Borough Council and the Planning Commission shall evaluate its impacts against the compatibility standards in Article XVII.
A. 
Outdoor storage shall be in the rear yard only, provided that such storage area is completely screened from the street and sidewalk by an opaque fence or planted visual screen and shall comply with the screening requirements in Article XVII. Only those materials, items, or products generated by or directly related to the business conducted on the property shall be stored. There shall be no storage of items from sources other than the subject property.
B. 
Off-street parking and loading, subject to Article XV.
C. 
Signs, subject to Article XVI.
D. 
Any accessory use on the same lot with and customarily incidental to any of the uses permitted above and not detrimental to the area.
Unless stated otherwise, the following shall be minimum requirements:
A. 
Lot area: 3,000 square feet.
B. 
Lot width:
(1) 
Thirty feet for detached structures.
(2) 
Twenty feet for attached structures with 30 feet at the end of a row.
C. 
Building coverage: 60%, maximum.
D. 
Impervious surface: 70%, maximum.
E. 
Front yard: conforming to that of the established street setback line or 10 feet.
F. 
Rear yard: 20 feet.
G. 
Side yard: eight feet on each side of a building with attached units. Five feet on each side of individual, detached buildings.
H. 
Height: 35 feet or three stories, maximum.
A. 
Each permitted use shall provide and maintain attractively landscaped grounds and include screening necessary to protect adjacent residential properties and obscure storage areas from streets or residences.
B. 
Screening and landscaping shall comply with Article XVII.
C. 
Any new construction or addition to the building, and especially to its facade, shall be in harmony with the architectural character of the adjacent area in terms of style, size, proportion, and materials.
D. 
All signs, lighting, benches, and similar structures and amenities shall be designed and built in keeping with the architectural character and theme of the Central Retail District, as recommended in the most recently adopted Marcus Hook Comprehensive Plan.
E. 
All principal uses shall be completely enclosed in a building, and no drive-in restaurant, drive-in bank, or similar drive-in establishment shall be permitted.
F. 
No goods, articles, or equipment shall be stored, displayed, or offered for sale beyond (in front of) the front line of a building, except for temporary sales or promotions lasting not more than three days. Any event or sale including display or sale beyond the front building line of a building that exceeds three days' duration shall require a permit from the Borough.
G. 
In a restaurant that serves alcoholic beverages, not more than 20% of the floor area shall be devoted to the bar or drinking section.
H. 
All applicable provisions of Article XVI, Signs, shall be followed.
