There is hereby created in the Borough of Derry a department to be known as the "Department of Borough Planning," which shall be in charge of a Borough Planning Commission to be known as the "Derry Borough Planning Commission."

The Derry Borough Planning Commission shall consist of three members, each of whom shall be a resident of the Borough of Derry, and at least two of whom shall be citizen members who shall not be officers or employees of Derry Borough. All members shall be appointed by motion duly adopted by the Council of the Borough of Derry for a term of four years. An appointment to fill a vacancy shall be only for the unexpired portion of any term. Any member of the Borough of Derry Planning Commission may be removed from office by the Borough Council after a public hearing in accordance with the Local Agency Law,[1] and said removal based upon inefficiency, neglect of duty, or malfeasance in office.

The Derry Borough Planning Commission shall have such powers as will reasonably enable it to carry out its purpose and promote Borough planning; and shall have all of the powers and duties as provided for a Borough planning commission by the Acts of Assembly by the Commonwealth of Pennsylvania.
The Derry Borough Planning Commission may make and alter rules and regulations for their own organization and procedure, consistent with the ordinances of the Borough of Derry and the laws of the Commonwealth of Pennsylvania, and shall elect their own Chairman.
The Derry Borough Planning Commission shall keep complete accounts and records of its transactions, resolutions and other business, all of which shall constitute and be a public record.
The members of the Commission shall serve without compensation, and the Commission shall make an annual report to the Council of the Borough of Derry of its progress, activities and transactions.
The Commission may employ engineers and other persons, whose salaries and wages and other necessary expenses of the Commission, where approved by Council, shall be provided for through proper appropriation by Council. The Commission may contract for professional planning services, the costs and expenses of which, when approved by Council, shall be provided for through proper appropriation by the Council.
The Council of the Borough of Derry shall annually appropriate from the General Borough Fund such money as it deems necessary for the work of the Planning Commission.
All meetings of the Planning Commission are public meetings and shall be open to the public.
