The Borough of Derry, through its Council, is hereby authorized to create and establish jointly with the Township of Derry, the Derry Area School District and the Borough of New Alexandria a Recreational Board, to be known as the "Derry Area Recreational Board."

The Derry Area Recreational Board shall consist of 11 members; four members shall be from the Derry Area School District; three members shall be from the Township of Derry; two members shall be from the Borough of Derry; one member shall be from the Borough of New Alexandria; and one member from the Derry Community Development Corporation.
All members of the Derry Area Recreational Board shall serve on said Board without compensation; however, said members from the Borough of Derry shall be reimbursed for authorized and necessary and reasonable expenses incurred in the performance of their duties, upon presentation to the Council of the Borough of Derry of a verified statement of such necessary expenses.

The members of the Derry Area Recreational Board who are from the Borough of Derry shall be appointed by the Council of the Borough of Derry. The terms of the members of the Derry Area Recreational Board shall be as follows:
A. 
Four members for three years;
B. 
Four members for two years; and
C. 
Three members for one year.

The Derry Area Recreational Board shall be authorized and directed to equip, operate and maintain the recreational places now existing or hereafter established by the Township of Derry, Borough of Derry, Derry Area School District, Borough of New Alexandria, and the Derry Community Development Corporation, in accordance with the appropriations and directions made to the Derry Recreational Board by the Township of Derry, Borough of Derry, Derry Area School District, Borough of New Alexandria and Derry Community Development Corporation.

The Borough of Derry may contribute on an annual basis, at its sole discretion, a sum to the Derry Area Recreation Board.
The Borough of Derry has the right to withdraw from the Derry Area Recreational Board upon 30 days' notice prior to the end of the calendar year.
The names and terms of the members of the Derry Area Recreational Board from the Borough of Derry shall be named by the Council of the Borough of Derry.

The Derry Area Recreation Board heretofore organized and established by joint ordinances and/or resolutions of the Borough of Derry, the Derry Area School District, the Township of Derry and the Borough of New Alexandria is hereby permitted to incorporate as a nonprofit organization operating under the laws of the Commonwealth of Pennsylvania.

The nonprofit corporation so created shall continue to exist and function subject to the conditions and provisions of the ordinances previously passed by the Council of the Borough of Derry creating and establishing the same.
