No person shall keep a billiard table or pool table, bowling alley or shuffleboard for public use or hire within the Borough of Ho-Ho-Kus without first obtaining a license.
Application for such license shall state the location of the building and room where such billiard table, pool table, bowling alley or shuffleboard are to be used, the name of the applicant, the number of tables, bowling alleys or shuffleboards, and the name of the owner of the building.
All licenses granted under the provisions of this article shall be issued by the Borough Clerk at the direction of the Borough Council.
The Council shall have power to revoke or suspend any such license, in its discretion, in case gambling or disorderly conduct is permitted or any of the provisions of this article violated, and, after hearing before said Council, the licensee should be determined to be a person unfit for the conduct of such business. Unless sooner revoked, all licenses shall expire on the 31st day of December next ensuing the date of issuing the same.
The annual license fee for keeping a billiard parlor, pool parlor, bowling alley or shuffleboard shall be $5 for each table or shuffleboard and $10 for each bowling alley. The minimum fee, however, for any such place, shall be the sum of $25.
The license fee herein fixed is for revenue.
No minor under the age of 18 years shall be permitted to play billiards, pool, bowling or shuffleboard in any place licensed under the provisions of this article, except under the consent of his parent or guardian.
A. 
All places licensed under the provisions of this article shall close every night at 12:00 midnight and remain closed until 7:00 a.m. each day. The time herein specified shall be standard or daylight saving time when and as used in the Borough.
B. 
No loitering by minors under the age of 18 shall be permitted. Such places, while open, shall have an unobstructed view from the street. No curtains, shades or other obstructions to view shall be permitted on any windows.
C. 
All places licensed under the provisions of this article shall be subject at all times to police inspection and shall be closed on the first day of the week, commonly known as Sunday.
Any person or persons violating any of the provisions of this article shall be liable to a penalty either by imprisonment in the county jail for a term not exceeding 10 days or a fine not exceeding $100, or both, for each offense, as the Magistrate before whom conviction is had shall determine, who shall fix the amount of said penalty not in excess of the maximum herein provided.
This article shall take effect 10 days after the publication thereof as required by law.
