For the purpose of this chapter, the following terms, phrases,
words and their derivations shall have the meanings given herein:
CONDOMINIUM
The form of ownership of real property under a master deed
providing for ownership by one or more owners of units of improvements,
together with an undivided interest in common elements appurtenant
to each such unit.
CONDOMINIUM ASSOCIATION
The entity responsible for the administration of a condominium,
which entity shall be incorporated or unincorporated.
CONDOMINIUM PROPERTY
The land covered by the master deed, whether or not contiguous,
and all improvements thereon, all owned either in fee simple or under
lease, and all easements, rights and appurtenances belonging thereto
or intended for the benefit thereof.
COOPERATIVE
Any system of land ownership and possession in which the
fee title to the land and structure is owned by a corporation or other
legal entity in which the shareholders or other co-owners each also
have a long-term propriety lease or other long-term arrangement of
exclusive possession for a specific unit of occupancy space located
within the same structure.
COOPERATIVE ASSOCIATION
The entity responsible for the administration of a cooperative,
which entity may be incorporated or unincorporated, profit or nonprofit.
PERSON
An individual, firm, corporation, partnership, association,
trust or other legal entity, or any combination thereof.
Every condominium and/or cooperative association established
to administer property within the Borough of Ho-Ho-Kus shall register
on an annual basis with the Borough Clerk on forms to be furnished
by the Borough. Registration shall be made annually during the month
of October.
Each registration shall state the following information:
A. The address of the subject property.
B. The name, address and telephone number (day and evening) of the person
designated by the association to serve as agent for said association.
C. The names, addresses and telephone numbers (day and evening) of the
current association officers.
D. The number of units being a part of the condominium or cooperative
property designated or intended for occupancy.
E. The names, addresses and telephone numbers (day and evening) of persons
currently authorized to service the heating, electric and plumbing
systems within the condominium and/or cooperative property.
It shall be the obligation of every condominium and/or cooperative association, or designated agent in lieu thereof, to notify the Borough Clerk, in writing, within 14 days from the date of any change relating to the information required to be provided under §
15-3 herein.
A fee of $25 shall be imposed for the filing of the annual registration
form with the Borough Clerk.
This chapter, being necessary for the welfare of the Borough
and its inhabitants, shall be liberally construed to effectuate the
purposes thereof.
Any person violating any of the provisions of this chapter shall,
upon conviction thereof, be subject to a fine of not exceeding $200.
