GENERAL REFERENCES
Uniform construction codes — See Ch. 158.
Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c. 383; N.J.S.A. 52:27D-192 et seq.), the New Jersey Uniform Fire Code (N.J.A.C. 5:18-1.1 et seq.) shall be locally enforced in the Township of Delaware.
A. 
The local enforcing agency shall be the Bureau of Fire Prevention, which is hereby created in the Township of Delaware.
B. 
The Bureau of Fire Prevention shall consist of three persons appointed by the Township Committee. One such member shall be the fire subcode official. At least two members shall also be members of the Fire Department.
C. 
The Bureau of Fire Prevention shall be under the direct management and supervision of the fire official, who shall be deemed the chief administrator of the bureau.
The Bureau of Fire Prevention shall enforce the Uniform Fire Safety Act and the codes and regulations adopted under it in all buildings, structures and premises within the established boundaries of the Township of Delaware, other than owner-occupied one and two-family dwellings, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.
The Bureau of Fire Prevention as established by § 197-2 shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the New Jersey Commissioner of Community Affairs.
The Bureau of Fire Prevention as established by § 197-2 of this chapter shall be a bureau of the Delaware Township Committee and shall be under the direct supervision and control of the Delaware Township Committee.
A. 
Appointment of fire official. The fire official shall be an active member of the Fire Department appointed by the Township Committee upon recommendation of the Fire Department.
B. 
Inspectors and employees. Such inspectors and other employees as may be necessary for the Bureau to carry out its responsibilities properly shall be appointed by the Township Committee pursuant to recommendation by the Bureau of Fire Prevention.
C. 
Term of office. The fire official and inspectors shall serve for a term of one year. Any vacancy shall be filled for the unexpired term.
D. 
Removal. All personnel of the Bureau shall be subject to removal by the Township Committee for good cause. Prior to such removal, personnel shall be afforded an opportunity to be heard by the appointing authority, or a designated hearing officer, at the option of the appointing authority.
Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act, any person aggrieved by any order of the fire official shall have the right to appeal to the Hunterdon County Construction Board of Appeals.

The Township of Delaware shall charge an initial smoke detector inspection fee of $25. The Township of Delaware shall charge an additional $25 fee for each smoke detector reinspection.
