GENERAL REFERENCES
Streets and sidewalks — See Ch. 319.
For the purpose of this chapter, the following terms shall have the meaning indicated:
SPECIAL ROAD EVENT
Includes any bikeathon, marathon run (of any distance), walkathon, or similarly organized road event consisting of not less than 15 participants, which intends to proceed along a public street or other public right-of-way within the Township.
An application for a permit to conduct a special road event shall be made to the Chief of Police in writing by the person or persons in charge or responsible for said event. A fee of $50 shall accompany the application. This fee may be waived upon submission of documents verifying that the sponsoring group is a nonprofit organization as defined by the statutes of the State of New Jersey or Section 501(c)(3) of the Internal Revenue Code. Such application shall set forth the following information:
A. 
The name, address and telephone number of the person requesting the permit.
B. 
The name and address of the organization or group he or she is representing.
C. 
The name, address and telephone number of the person or persons who will act as chairman of the special road event and be responsible for the conduct thereof.
D. 
The number of monitors to be provided and the identifying marks, badges or symbols to be worn or used by the monitors.
E. 
The purpose of the event, the estimated number of persons to participate and otherwise attend, and the plans for parking all vehicles.
F. 
The method of notifying participants of the terms and conditions of the special event.
G. 
The date the event is to be conducted and the hours it will be commenced and terminated.
H. 
The location where the special event is to be held, including the specific assembly and dispersal location, and the proposed route and the plans for assembly and dispersal of the participants.
I. 
Whether or not any music will be provided, either live or recorded.
J. 
The number, types and locations of all loudspeakers, and amplifying devices to be used.
K. 
Whether any admission fee will be charged for participation in the special event and the amount of said fee, if any.
L. 
Such other information as the Chief of Police may deem necessary in order to properly provide for traffic control, street and property maintenance and the protection of the public health, safety and welfare.
A permit shall issue upon a finding by the Township Committee that:
A. 
The conduct of the special road event will not substantially interrupt the safe and orderly movement of other traffic contiguous to its routes.
B. 
The conduct of the special road event will not require the diversion of so great a number of police officers of the Township of Delaware to properly police the line of movement and the area contiguous thereto as to prevent normal police protection of the Township of Delaware.
C. 
The conduct of such special road event will not require the division of so great a number of ambulances as to prevent normal ambulance service to the portions of the Township of Delaware other than that to be occupied by the proposed line of march in areas contiguous thereto.
D. 
The concentration of persons, animals and vehicles at assembly points of the special road event will not unduly interfere with the proper fire and police protection of or ambulance service to areas contiguous to such assembly areas.
E. 
The conduct of such special road event will not interfere with the movement of firefighting equipment en route to a fire.
F. 
The special road event is scheduled to move from its point of origin and to its point of termination expeditiously and without unreasonable delays en route.
No such permit shall be issued for a special road event unless application for said permit has been made not less than 30 days in advance of the date on which said special event is sought to be held. Any such special road events shall take place only during daylight hours. All directional signs erected in connection with the special event shall be removed within 24 hours following the termination of said event. The Chief of Police shall review the proposed course of travel for the said event and may alter or totally redesignate the course of travel, as he may deem necessary to insure public safety.
Any permit granted under this chapter may contain conditions reasonably calculated to reduce or minimize dangers and hazards to vehicular or pedestrian traffic and the public health, safety and welfare, including but not limited to changes in the date, time duration or number of participants as requested by the applicant. For the purposes of public safety and welfare, Chief of Police may order the temporary closing of streets and/or the temporary prohibition of parking along same during the event, and shall direct the posting of proper warning signs in connection with said event, as provided by law.

A. 
If the Chief of Police determines the additional police officers will be required for purpose of preserving the public health, safety and welfare during the course of the special event, the holder of the special event permit shall deposit in advance of the holding of said event a sum of money to be determined by the Chief of Police to pay in full for all police service which the Chief of Police deems necessary in connection with the special event. Any officers required shall be paid for by the organizer/sponsor of the event.
B. 
If additional costs are incurred for the purpose of providing police protection, the holder of the permit shall be required to pay the Township the additional funds within 10 days of notification by the Township as to the exact figure due. In the event that the sum of money so deposited in advance exceeds the funds needed to pay for actual police protection, the Township shall refund any excess deposit within 10 days after the holding of said special event.
The holder of a special road event permit shall agree in writing to indemnify and hold harmless the Township, its servants, agents and employees for any and all claims caused by or arising out of the activity covered in said permit. Further, the holder of said permit shall present to the Chief of Police an insurance policy in a form acceptable to said Chief of Police which will provide for the indemnification as aforementioned.
