[HISTORY: Adopted by the Mayor and Council of the Borough of High Bridge 2-9-2006 as Sec. 2-58 of the 2006 Code of the Borough of High Bridge. Amendments noted where applicable.]
There is hereby established a Department of Public Works, the head of which shall be known as the "Director of Public Works." The Department shall consist of two units:
A. 
Maintenance: responsible for all streets, roads, storm sewers, public property and repair;
B. 
Water and Sewer: responsible for all public water connections, water purity and all sanitary sewers.
A. 
Creation of office; appointment. The Office of Director of Public Works is hereby created. He shall be appointed by the Mayor with the advice and consent of Borough Council.
B. 
Duties; supervisions. The Director shall, subject to the control of the Mayor and Council, be in charge and control of the Department of Public Works and report directly to the Administrator for day-to-day affairs. In the event of the Director's absence due to disability, the Mayor, with the consent of the Council, shall appoint a successor. During the Director's vacation time or sick leave, the Director shall designate a member of his Department to assume his duties and powers and shall notify the Mayor and Council of such designation in writing. The Director of Public Works shall be in charge of and have supervision over:
(1) 
Parks and public property.
(2) 
Roads, streets and sidewalks.
(3) 
Road equipment, trucks and materials.
(4) 
Storm sewers.
(5) 
Sanitary sewers and sanitation.
(6) 
Water quality.
(7) 
Private property adherence to Borough ordinances.
C. 
Additional duties.
(1) 
The Director of Public Works may be requested to make minor repairs to road, police and fire equipment. The Public Works Department shall assist all other departments, committees, boards and councils, to the best of its ability and skill sets, by providing skilled labor and knowledge.
(2) 
He shall discharge such other duties as the Mayor and/or Council and/or Administrator may impose from time to time, consistent with the duties specifically set forth in this section.
A. 
Creation of office. There is hereby created the Office of Water and Sewer Inspector for the purpose of inspection of water and sewer connections. The appointment of the position is by the Mayor with the advice and consent of Council.
B. 
Powers and duties.
(1) 
It shall be the duty of the Water and Sewer Inspector to inspect water and sewer connections located within and outside of buildings in the Borough of High Bridge or in any area served by the water and sewer utilities.
(2) 
The Water and Sewer Inspector is hereby granted authority to enter with probable cause if believed there is a problem or violation onto any residential, commercial, industrial or other building in the Borough of High Bridge for the purpose of ascertaining whether connections to the water and sewer systems are proper. The Inspector shall examine the connections for any deficiencies or leaks and report any improper connections to the Director of Public Works, who shall notify the Borough Administrator.
C. 
Notice to occupants. The Inspector shall, in the event that he is denied entry for inspection or no one is available to grant entry, give a written notice to the owner or tenant occupying the premises of at least three days' notice of his intent to make such inspection. The property owner or tenant shall then provide adequate access for the Inspector to examine the connections in question and ascertain whether they are properly hooked up to the Borough's systems.
D. 
Deficiencies in connections. In the event that a deficiency is found in the connection, the Inspector shall, in writing, list the deficiencies found. A copy of the list of deficiencies shall be served upon the property owner or tenant personally or by certified mail, return receipt requested, and the original shall be delivered to the Director of Public Works. Any person, corporation or other property owner served with such notice shall correct the deficiency within two weeks (14 days) of the receipt of said notice.
E. 
Violations and penalties. Any person who violates the terms of this section shall be punishable as provided in Chapter 1, Article II, General Penalty. In the event that a property owner fails to correct a deficiency indicated within two weeks of receipt of said notice, the Water and Sewer Department are authorized to terminate service.[1]
