[Adopted 2-9-2006 as Ch. 209 of the 2006 Code of the Borough of High Bridge]
A code regulating the manner in which refuse may be stored, collected and disposed of; declaring and defining certain conditions as nuisances; fixing the responsibilities and duties of persons storing, collecting and/or disposing of refuse and providing for issuance of permits to collect refuse, known as the Solid Waste Code of New Jersey (1959), is hereby established. A copy of said code is annexed hereto and made a part hereof without the inclusion of the text thereof herein.

Three copies of said Solid Waste Code of New Jersey (1959) have been placed on file in the office of the Hunterdon County Department of Health upon the introduction of this article and will remain on file there, for use and examination by the public, until final action is taken on this article.
There is hereby established a solid waste disposal utility charge to reflect the solid waste disposal utility's actual costs. Each dwelling unit billing shall be computed to include all administrative, operating and capital costs for the removal of solid waste and recycling. The annual charge shall be established by resolution of the Mayor and Council and shall be billed in four quarterly installments. Commercial units using a dumpster shall contract solid waste removal on their own.
The Borough of High Bridge shall bill the owner of record of each property for garbage pickup charges. All residential households will be charged for solid waste pickup. All charges will be issued on the quarterly water, sewer and solid waste bills. Charges shall be a lien on the property in question and, if unpaid, shall be collected in the same manner as collection for delinquent taxes as provided for by law.

Any person who violates any provision of or order promulgated under this article or the code established herein shall, upon conviction thereof, be punishable as provided in Chapter 1, Article II, General Penalty. Each day a particular violation continues shall constitute a separate offense.
