All garbage collection points and locations must be accessible
to Borough garbage trucks and equipment and the collection facilities
and locations must meet all applicable regulations and standards.
Each residential condominium complex, through its association, must
apply in writing to the Director of Public Utilities for this municipal
garbage collection service, demonstrate and provide proper accessibility
and facilities, and receive the approval of the Director as to the
required accessibility and facilities prior to said municipal service
being provided.
As part of said application and approval process, the residential
condominium association shall properly approve and execute a hold-harmless
indemnification agreement in a form approved by the Borough Attorney.
This agreement shall basically hold harmless and indemnify the Borough
from claims arising by reason of the Borough or its employees entering
upon and performing work upon private property owned by the residential
condominium association.
