Pursuant to N.J.S.A. 27:5I-1, and any amendments thereto, municipal
consent, in the form of a permit, shall be required to park, or leave
unattended, any waste or refuse container, commonly known as "roll-off
dumpsters" or "roll-off containers," on or along any sidewalk, street,
thoroughfare, or public property in the Borough shall only be valid
and remain in effect for up to 15 days, or for a shorter period of
time, as set forth on the permit issued by the appropriate official.
Permits for parking and leaving unattended any waste or refuse
containers on any municipal sidewalk, street, thoroughfare, or public
property, shall be issued by the Traffic Safety Officer of the Borough
of Red Bank Police Department, or his or her designee. The appropriate
official to provide consent for the parking of any such container
on any county or state highway shall be the person so designated by
the state or county, as applicable.
All waste or refuse containers parked, or left unattended, within
the Borough shall comply with all requirements set forth in N.J.S.A.
27:5I-1, as amended. In addition, if in the judgment of the Traffic
Safety Officer the parking of a waste or refuse container constitutes
an unreasonable traffic or pedestrian safety hazard, the Traffic Safety
Officer may impose such additional conditions upon the permit to be
issued that may be reasonably necessary to remediate, or mitigate,
any such hazard.
An appropriate form for obtaining a permit to park, or leave
unattended, any waste or refuse containers shall be developed by the
Police Department and the Traffic Safety Officer. That form shall
be the designated form for use by any person seeking to park or leave
unattended any waste or refuse container on a municipal sidewalk,
street, thoroughfare, or public property.
The application form shall require that the applicant acknowledge
his or her understanding of the requirements concerning the illumination
and marking of the waste or refuse container as set forth in this
article and in N.J.S.A. 27:5I-1.
The Traffic Safety Officer, or his or her designee, shall state
on each permit such special conditions that may be required and the
calendar date that the permit expires.
The fee for a permit under this article shall be $50 for the
first 15 days and $100 for each fifteen-day period thereafter.
Renewal of any permits hereunder shall require the permittee
to file a new application and fee in order to obtain a new permit,
the granting of which shall be at the discretion of the Traffic Safety
Officer, or his or her designee.
The parking or leaving unattended any waste or refuse container,
in violation of this article, or of N.J.S.A. 27:5I-1, shall be deemed
a violation of both the property owner for whose purposes the container
has been placed, as well as the person or entity placing the container
on the highway or public property.
