Whenever snow has fallen and the accumulation is such that plowing and/or snow removal will be required by the Borough, an emergency is deemed to exist and no vehicles shall be parked on any street or highway within the Borough. Such parking prohibition shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
Any unoccupied vehicle parked or standing in violation of this article shall be deemed a nuisance to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of such removal and storage before regaining possession of the vehicle.
Signs bearing the legend "NO PARKING WHEN ROADS ARE SNOW COVERED" are authorized to be posted under the supervision of the Borough Engineer.
Any person who violates any provision of this article shall, upon conviction thereof, be punished with a fine of not more than $100 or imprisonment for a term not to exceed 15 days or both.
All other provisions of this chapter which are not affected by this amendatory article are hereby ratified and confirmed and shall remain in full force and effect. However, all ordinances or parts of ordinances, which are inconsistent with the provisions of this amendatory article are hereby repealed to the extent of such inconsistency.
If any portion of this article is adjudged unconstitutional or invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this article, but shall be confined in its effect to the provision directly involved in the controversy in which such judgment shall have been rendered.
This article shall take effect after final passage and publication as required by law.
