Not more than three plenary retail consumption licenses for the sale of alcoholic beverages shall or may be issued and outstanding at any one time in the Borough.
Not more than two plenary retail distribution licenses for the sale of alcoholic beverages shall or may be issued and outstanding at any one time in the Borough.

Not more than one club license for the sale of alcoholic beverages shall or may be issued and outstanding at any one time in said Borough, and the annual fee for such club license shall be and the same is hereby fixed at the sum of $180.

The annual fee for each and every plenary retail distribution license that shall hereafter be issued in the Borough shall be $2,500.

No alcoholic beverages shall be sold or consumed within any establishment holding a plenary retail alcoholic beverage consumption license or a club alcoholic beverage license between the hours of 2:00 a.m. and 7:00 a.m. on any day of the year.

No alcoholic beverage shall be sold within the Borough by the holder of a plenary retail distribution license between the hours of 10:00 p.m. and 9:00 a.m. except on the first of January, as hereinabove provided.[1]

Alcoholic beverages may be sold in this Borough on election days subject to all of the other provisions of the laws of this state, the rules and regulations of the Division of Alcoholic Beverage Control and the ordinances of this Borough.

The hours referred to in this article shall be Eastern standard time or Eastern daylight saving time, whichever time shall be in effect.
No person shall sell or offer for sale, or have in his or her possession for sale, any alcoholic beverage or beverages unless such sale, offer for sale or possession for sale shall be authorized by a license duly issued, outstanding and valid.
Each and every license for the sale of alcoholic beverages that shall be issued by virtue of the authority of this article shall be issued subject to the Alcoholic Beverage Law of the State of New Jersey and to the rules and regulations established by the Commissioner of Alcoholic Beverage Control of said state, and to the terms and provisions of this article and such other rules and regulations as may hereafter be adopted by the Borough Council of the said Borough.
Any license issued under the provisions of this article may be suspended or revoked by the governing body of the said Borough, upon the conviction, after hearing, of the holder of such license for any violation of the Alcoholic Beverage Law of the State of New Jersey or the rules and regulations established by the Commissioner of Alcoholic Beverage Control of said state or the terms and provisions of this article or any rules and regulations that may hereafter be adopted by the governing body of the said Borough.

A. 
No individual, partnership, corporation or other entity holding any type of alcoholic beverage license shall employ any person in or about any licensed premises, except entertainers, who has not been issued an identification card by the Police Department of the Borough of Seaside Park. All persons presently so employed shall report to the Police Department for fingerprint and identification checks, photographs and the issuance of identification cards within 30 days of the effective date of this article.
B. 
All persons employed in or about any licensed premises, except entertainers, shall carry an identification card issued by the Police Department at all times while in the course of their employment and shall exhibit the same upon the request of any authorized Borough official.
C. 
Any person desiring to obtain an identification card shall report to Police Headquarters where application forms shall be completed and fingerprints submitted and a photograph obtained. The applicant shall pay a fee of $30 for an identification card in addition to state and federal fingerprint processing fees. The fee for the identification card shall cover a one-year period. Said identification cards may be renewed yearly for a fee of $30.
D. 
The Police Department shall issue an identification card to each employee, which card shall contain the name, address and a photograph of the employee. A copy of the identification card and photograph shall be maintained on file by the Police Department.
E. 
It shall be the duty of any alcoholic beverage licensee to ensure that all of its employees comply with the provisions of this article.

Any person who shall violate any of the terms or provisions of this article or do any act or thing therein prohibited shall, upon conviction thereof, be subject to the general penalty in Chapter 1, Article II, General Penalty, of the Borough Code.
