No stormwater runoff or natural drainage water shall be so diverted as to overload existing drainage systems or create flooding or the need for additional drainage structures on other private properties or public lands without proper and approved provisions being made for taking of these conditions.

The owner of a lot who intends the installation or construction of any improvements or materials, including but not limited to asphalt, concrete or other impervious surface on a parcel, shall first apply to the Borough Zoning Officer for a permit, except in the case of the installation of a driveway to a garage which would not exceed 13 feet in width for a one-car garage and 16 feet in width for a two-car garage. This exception shall only apply in the event that a garage exists on the lot.
Permit applications shall indicate on sketch plot the area of the parcel, the proposed improvements and total impervious surface area of the lot.

The application shall be approved by the Borough Zoning Officer if said plans shall conform with local and state regulations concerning stormwater runoff and drainage systems and does not increase existing runoff from the site by 15% over the existing conditions.

There shall be no fee for the permit required in accordance with § 399-2.

Any person who violates any one or more sections of this article shall be subject to the general penalty in Chapter 1, Article II, General Penalty, of the Borough Code, and the minimum fine shall be not less than $500.
