The following locations are hereby designated as wharfs and piers for fishing, crabbing, and other public recreation:
A. 
Areas between the curbline of K Street and the adjacent bulkhead.
B. 
Areas between the curbline of Lake Avenue and the adjacent bulkhead, including those portions from M Street to N Street and the portion between N Street and O Street.
C. 
Designate 14th Avenue and 5th Avenue as piers.

A. 
The designated wharfs shall be open and used for fishing and crabbing between the hours of 9:00 a.m. and 9:00 p.m. and shall be closed for fishing and crabbing between the hours of 9:00 p.m. and 9:00 a.m.
B. 
The designated piers shall be open and used for fishing and crabbing between the hours of 5:00 a.m. and 12:00 midnight and shall be closed for fishing and crabbing between the hours of 12:00 midnight and 5:00 a.m.
This municipality may engage, hire and pay such supervisory personnel and attendants and such other personnel as may be required for the proper maintenance of the designated wharfs.

In order to provide funds to improve, maintain and police designated wharfs and piers and to protect the same from damage, all persons 12 years of age and over using such facilities to actively fish or crab shall be required to have in their possession and shall have conspicuously displayed on their person a current beach badge issued in accordance with the provisions of § 135-7 of the Code of the Borough of Seaside Park.

No person shall do any of the following things at or upon the designated wharf and pier areas:
A. 
Throw, drop, discard or leave any wastepaper, garbage or other refuse; or sell, peddle or hawk any items, including food, drink and confections.
B. 
In any way litter, make unsightly, damage, destroy or disfigure any public or private property.
C. 
Dump or throw garbage or other refuse in water.
D. 
Molest or disturb any person in the peaceful enjoyment of said wharf areas.
E. 
Make any loud noise, sound or music to the annoyance of any other person.
F. 
Use loud profane or indecent language.
G. 
Take or permit a dog or other animal to be or go upon said wharf areas.
H. 
Play ball or any other game or engage in any activity which will endanger another person or interfere with the enjoyment of the quiet use of said wharf areas by another person.
I. 
Swimming, diving or bathing.
J. 
Skateboarding, roller-blading, roller-skating, bicycling or other similar activity.
K. 
Operate a privately owned motor vehicle on the wharf area at any time.
L. 
Tie up any boat or vessel.
M. 
Do anything which shall endanger the life or safety of himself, herself or any other person.
N. 
Refuse or neglect to obey the orders and directions of the supervisory personnel.
O. 
Interfere with or obstruct a police officer or supervisory personnel in the performance of their duty.
P. 
Disrobe, dress or undress on the wharf or in automobiles thereat.
Q. 
Conduct or engage in any party or similar outing on the wharf areas.
R. 
Take or permit any glass container, glass bottle or glass jar upon said wharf areas.
S. 
Intoxicating liquor shall not be taken upon said wharf areas.
T. 
No one using said wharf areas for the purposes of crabbing and fishing shall interfere with the free passage of boats using the channel adjoining said wharf areas.[1]

Editor's Note: Original § 80-5U of the 19070 Borough Code, prohibiting crabbing and fishing along a certain portion of K Street, which immediately followed this subsection, was repealed at time of adoption of Code (see Ch. 1, General Provisions, Art. I).
All provision of this chapter shall be applicable to and shall pertain to the designated wharf areas of the municipality and such other areas as may be designated by resolution of the Borough Council from time to time.
Any person who violates any one or more sections of this chapter shall be subject to the general penalty in Chapter 1, Article II, General Penalty, of the Borough Code.
