Pursuant to the provisions of § 42 of the Town Law of the State of New York, the Town Board does hereby establish the office of Deputy Supervisor.
The Deputy Supervisor shall be appointed by the Supervisor to serve at the pleasure of the Supervisor, and, in case the office of Supervisor becomes vacant, or in case the Supervisor shall be absent or unable to act, the Deputy Supervisor in office at that time shall assume all duties and obligations of the Supervisor under the Code of the Town of Hempstead and the Town Law of the State of New York and shall continue in such capacity until a new Supervisor shall assume office or the absent or incapacitated Supervisor shall return to office. This shall include, but not be limited to, the power to preside at meetings of the Town Board. In his capacity as such, the Deputy Supervisor shall have no vote on matters coming before the Town Board.
Upon the appointment of a Deputy Supervisor as authorized herein, such Deputy Supervisor shall, within 15 days thereafter, take the oath of office and file the undertaking required of a Supervisor pursuant to § 25 of the Town Law of the State of New York, and such Deputy Supervisor shall be subject to all the obligations thereof.
Any person, including a town officer, official or employee, may be appointed Deputy Supervisor, provided that the person appointed shall possess the same qualifications as an elective town officer pursuant to § 23 of the Town Law of the State of New York.
Upon the appointment of a Deputy Supervisor, the Town Board shall, by resolution, fix the compensation which the Deputy Supervisor shall receive, which compensation may be in addition to any other compensation he or she may receive as a town officer, town official or town employee, and may amend such compensation by resolution as it may thereafter deem appropriate.
In the event that any provision of this chapter shall be deemed illegal or otherwise unenforceable as a matter of law by a court of competent jurisdiction, then only that specific section shall be unenforced, and all other sections shall remain in full force and effect.
