COMMISSIONER — The Commissioner of the Police Department of the County of Nassau.
PARADE
Any public assembly which has movement on any of the sidewalks, streets, highways, parks or other public places in the Town.
PARADE PERMIT
A permit as required by this chapter.
PERSON
Any individual, firm, partnership, association, corporation, company or organization of any kind.
TOWN
The land area located within the boundary of the Town of Hempstead under the jurisdiction of the Town Board, excluding the City of Long Beach and the incorporated villages.
Where necessary, the singular shall include the plural, and the plural shall include the singular.
A. 
A parade shall be permitted upon any streets, highways, sidewalks, parks or in any public place in the Town only after a written permit therefor has been obtained from the Town Clerk.
B. 
Exceptions. This chapter shall not apply to:
(1) 
Ordinary and necessary movements of the armed forces of the United States, National Guard, fire departments and police departments.
(2) 
Funeral processions.
(3) 
Students while on their way to and departing from school or participating in related educational activities provided such movement is under the direction and control of the school.
A person seeking issuance of a parade permit shall file an application with the Town Clerk on forms provided by the Town Clerk.
A. 
Filing period. An application for a parade permit shall be filed with the Town Clerk not less than 15 days nor more than 30 days before the date on which it is proposed to conduct the parade.
B. 
Form. The application for a parade permit shall set forth the following information:
(1) 
The name, address and telephone number of the person seeking to conduct such parade.
(2) 
If the parade is proposed to be conducted for, on behalf of or by an organization, the name, principal address and telephone number of the organization.
(3) 
The name, address and telephone number of the person or officers of an organization authorized to be responsible for the good order and conduct of the parade.
(4) 
The date when the parade is to be conducted.
(5) 
The route to be traveled, the starting point and the termination point.
(6) 
The approximate number of persons who and animals and vehicles which will constitute such parade, the type of animals, and description of the vehicles.
(7) 
The time when the parade will commence and terminate.
(8) 
A statement as to whether the parade will occupy all or only a portion of the width of the streets proposed to be traversed.
(9) 
The location of the assembly area of the parade.
(10) 
The time of assembly.
(11) 
The distance to be maintained between units of the parade.
C. 
If the parade is designed to be held by and on behalf of or for any person other than the applicant, the applicant for such permit shall file with the Town Clerk a communication in writing from the person proposing to hold the parade, authorizing the applicant to apply for the permit on his behalf.
D. 
Waiver of time limitation. The Town Clerk where good cause is shown therefor, shall have the authority to consider any application hereunder which is filed less than 15 days before the date the parade is proposed to be conducted.
The Town Clerk, upon consultation with the Commissioner and approval of the Town Board, shall issue a permit as provided for hereunder when, from a consideration of the application and from such other information as may otherwise be obtained, he finds that:
A. 
The proposed parade will be orderly in character and not tend to disturb the public peace.
B. 
The conduct of the parade will not interrupt the normal ambulance service in the county.
C. 
The conduct of the parade will not interrupt the safe and orderly movement of traffic.
D. 
The concentration of persons, animals and vehicles at the assembly area of the parade will not interfere with proper fire, police and ambulance service.
E. 
The conduct of the parade will not interfere with the movement of fire-fighting equipment en route to a fire.
F. 
The parade is scheduled to move from its point of origin to its point of termination expeditiously and without delays en route.
G. 
The parade is not to be held for the sole purpose of advertising any product, goods or event, and is not designed to be held purely for private profit.
The Town Board, in denying an application for a parade permit, shall be empowered to authorize the conduct of the parade on a date, at a time or over a route different from that designated by the applicant. An applicant desiring to accept an alternate permit shall, within three days after notice of the action of the Town Board, file a written notice of acceptance with the Town Clerk. An alternate parade permit shall conform to the requirements of a parade permit under this chapter.
Immediately upon the issuance of a parade permit, the Town Clerk shall send a copy thereof to the following:
A. 
The Supervisor.
B. 
The Commissioner of Police of the Nassau County Police Department.
C. 
The Commissioner of the Department of Public Works of the Town of Hempstead.
D. 
The Commissioner of the Department of Public Works of the County of Nassau.
E. 
The fire departments of the hamlet or hamlets involved with the proposed parade route.
Each parade permit shall contain the following information:
A. 
The name and address of the person granted the permit.
B. 
The date the parade is to be conducted.
C. 
The assembly area, the starting point, the route to be traveled and the termination point.
D. 
The starting time and the approximate time the parade is to terminate.
E. 
Minimum speed.
F. 
Maximum speed.
G. 
Maximum interval of space to be maintained between the units of the parade, if any.
H. 
The portions of the streets to be traversed that may be occupied by the parade.
I. 
The maximum length of the parade in miles or fractions thereof.
A permittee hereunder shall comply with all permit terms and conditions and with all applicable laws and ordinances.
A. 
Possession of permit. The person granted the parade permit shall have the permit in his immediate possession at all times during the conduct of the parade and shall display the same upon demand of any police officer or the Town Clerk.
A. 
Interference. A person shall not hamper, obstruct, impede or interfere with any lawful parade or lawful parade assembly, nor with any person, vehicle or animal participating or used in a lawful parade.
B. 
Driving through parades. Except when authorized by a member of the Nassau County Police Department, a driver of a vehicle or conveyance shall not drive between the vehicles or persons comprising a parade.
C. 
Parking on parade route. The Commissioner shall have the authority to prohibit or restrict the parking of vehicles along a parade route. The Commissioner shall post signs to such effect, and it shall be unlawful for any person to park or leave unattended any vehicle in violation thereof.
D. 
Disobeying parade permit regulations. A person shall not disobey those regulations, terms or conditions contained in a parade permit, or any applicable law or ordinance, while participating in or observing a parade.
An infraction of §§ 117-2, 117-8 or 117-9 is a violation punishable by a fine not exceeding $250 or imprisonment for a period not exceeding 15 days for each such violation, or by both such fine and imprisonment.
