The Town of Hempstead has heretofore undertaken a workable program
meeting the requirements of Section 101(e) of the Housing Act of 1949,
as amended, requiring periodic reports and periodic recertification
by both the federal and state governments who require, among other
things, the development, approval or adoption and implementation of
a comprehensive general plan for the community as a whole. Pursuant
to its workable program the town has heretofore engaged the professional
services of planning consultants who have prepared a preliminary comprehensive
general plan entited "Town of Hempstead Comprehensive Development
Plan — 1967," hereinafter referred to as "the Plan."
Pursuant to the workable program it now becomes appropriate to take
effective measures for the engagement of public participation in the
ultimate approval or adoption by the Town Board of the plan by establishing
a Citizens' Advisory Planning Board.
It is intended hereby to provide an effective means of liaison
between the town's professional planners and the general public in
respect to the Plan.
In interpreting and applying the provisions of this local law,
the rules of interpretation applicable to remedial legislation shall
apply so that the spirit and intent of this local law shall be observed.
The compensation of the Board shall be fixed by Town Board resolution.
Such members shall be reimbursed for all incidental and necessary
expenses incurred in the discharge of their duties.
The Commissioner of the Department of Planning and Economic
Development, hereinafter called the "Commissioner," shall serve as
the Secretary of the Board, and one deputy designated by him shall
serve as Deputy Secretary. Neither the Secretary nor the Deputy Secretary
shall have a vote.
The Board shall have the following powers and functions:
A. To assist the Commissioner in making his recommendations to the Town
Board in respect to the plan.
B. To meet from time to time at the call of the Commissioner.
C. To conduct informal meetings, forums, workshops and seminars to encourage
public response to the several proposals advanced by the consultant
in the Comprehensive Development Plan.
D. To make rules for the conduct of their business.
E. To keep minutes of its proceedings.
F. To undertake such other matters as the Town Board or the Commissioner
may from time to time require.
Nothing herein contained shall be construed to delegate, diminish
or transfer any power of the Town Board, the Board of Zoning Appeals
or the Planning Board.
