The Police Department of the Borough of Ridgefield shall review
the recorded images produced by the system to determine whether sufficient
evidence exists demonstrating that a traffic control signal violation
has occurred and shall issue a summons when appropriate in accordance
with the rules of the Court.
The liability of the owner and operator of a motor vehicle for
a traffic control signal violation summons pursuant to the system
shall be joint subject to provisions of the Act.
Any person liable for a traffic control signal violation shall
be liable for the fines and penalties as prescribed by statute. Pursuant
to the provisions of N.J.S.A. 39:4-8.20, the full amount of fines
assessed for violations of N.J.S.A. 39:4-81 shall be paid to the financial
officer of the Borough of Ridgefield unless the Board of Chosen Freeholders
in the County of Bergen has elected to pay 1/2 of the cost of the
installation, maintenance and administration of the traffic control
signal monitoring system, in which case the fine will be split with
the county.
This article is contingent upon approval by the Commissioner
of Transportation as provided by statute, and further contingent upon
the Borough's award of a contract for the installation, operation
and maintenance of the traffic control signal monitoring system, and
the implementation of same. In all other respects, the program established
by this article shall be operated in conformity with all applicable
statutes, rules and regulations.
