[HISTORY: Adopted by the Mayor and Council of the Borough of Ridgefield 11-6-1974 by Ord. No. 992 as Ch. 13 of the 1967 Code. Amendments noted where applicable.]
There shall be in and for the Borough of Ridgefield a Board of Health in accordance with the provisions of the Act of the Legislature of New Jersey, entitled "An Act to establish in this state boards of health and a bureau of vital statistics, and to define their respective powers and duties," approved March 31, 1887, and the several supplements thereto.
Said Board of Health shall consist of seven members. The five present members of said Board shall serve for the terms for which they were originally appointed. The two additional members of said Board shall serve for terms to expire on January 1, 1957. All members of said Board shall be appointed by the Mayor by the advice and consent of a majority of the Borough Council and shall hold said office for the term of three years, except as heretofore provided herein, and except that in the case of vacancies, such vacancies shall be filled in the same manner in which the original appointment was made, but for the unexpired portion of the term only.
Said Board of Health shall adopt rules and regulations for its own government and shall elect a President from among its own members.
Said Board of Health shall appoint a Registrar of Vital Statistics, Clerk and Sanitary Inspector and may also appoint such other officers or assistants as the Board of Health may deem necessary; all appointees of said Board of Health shall be governed by the rules of said Board, and they may be removed for cause by said Board; the police and marshals of said borough, when on police duty, shall be special sanitary inspectors, and they shall promptly report to the Board of Health every violation of the health ordinances of the borough which may come within their observation or knowledge.
Said Board of Health shall not contract any debt or debts of any kind beyond the amount of the appropriation made for its use by this Council.
An ordinance entitled "An Ordinance constituting and concerning the Board of Health in the Borough of Ridgefield," approved October 20, 1922, is hereby repealed; provided, however, that all ordinances heretofore passed by the Board of Health in the Borough of Ridgefield, existing under said ordinance, shall remain in force until amended or repealed by the Board of Health appointed by this ordinance or their successors in office.[1]

A. 
License fees and other money collected or received, including all fees generated by the food handler's certification course under the Food Handler's Certification Ordinance shall be placed in a special account separate from any of the other accounts of the municipality and shall be used for the following purposes only:
(1) 
Audio/visual equipment to be used in connection with certification course.
(2) 
Tapes and other materials in connection with the course.
(3) 
Compensation of instructors.
(4) 
Miscellaneous expenses in connection with the certification course.
B. 
Any balance remaining in such account shall be retained until the end of the third fiscal year following and may be used for any of the purposes set forth in this section. At the end of the said third fiscal year, any balances shall be transferred from such special account to the general funds of the municipality.

The Board of Health shall exercise those powers as conferred to it under New Jersey law, and as the Board may determine is proper for the Board of Health to exercise. Included among the areas where the Board shall have authority to act, but without limitation, is (are) the following:
A. 
Supervision of all mental health services provided by the Borough, including, but not limited to, the use of a psychotherapist or other similar professional engaged by the Borough for use by its residents. The Council would also have to approve and be satisfied that certain safeguards are taken to maintain the confidentiality of the records of the psychotherapist.
