This chapter shall be known as the "Building Zoning Ordinance of the Village of South Floral Park."
A. 
Words used in the present tense include the future: the singular number includes the plural and vice versa; the word "lot" includes the word "plot": the word "building" includes the word "structure"; the word "shall" is always mandatory.
B. 
Unless otherwise expressly stated the following words, for the purpose of this chapter shall have the meanings herein indicated:
ACCESSORY BUILDING
A building subordinate to the main building on a lot and used for purposes customarily incidental to those of the main building.
ALTERATION
Any change or rearrangement of the structural parts of a building or structure or any enlargement thereof, whether by extending on any side or by increasing in height or by the moving from one location to another. It does not include ordinary repairs.
BUILDING HEIGHT
The vertical distance measured, in the case of flat roofs, from the curb level to the level of the highest point of the roof beams adjacent to the street walls and, in the case of pitched roofs, from the curb level to the average height of the gables and, where there are structures wholly or partly above the roof, from the curb level to the highest point of the building.
CURB LEVEL
The mean level of the curb at the street frontage of the building. Where the curb level is not established or the building sets back from the street line, the average ground level adjoining the street wall of the building shall be considered the curb level.
DEPTH OF A LOT
The mean distance from the street line of a lot to its rear line, measured in the general direction of the side lines of the lot.
FAMILY
Any number of individuals, related by blood, marriage or adoption, living and cooking together on the premises as a single housekeeping unit.
FRONT YARD
An open unoccupied space, across the full width of the lot, extending from the front wall of the building or any enclosed porch thereof to the street line of the lot.
LOT
Any parcel of land under one ownership, which is occupied by one building and its accessory buildings or uses, including such open spaces as are required:
(1) 
CORNER LOTA parcel of land (not over 28 feet in width) at the junction of and fronting on two intersecting streets.
(2) 
INTERIOR LOTA lot other than a corner lot.
NONCONFORMING BUILDING OR USE
One that does not conform to the regulations of the zone in which it is situated.
REAR YARD
An open unoccupied space, except for accessory buildings, across the full width of the lot, extending from the rear wall of the building to the rear line of the lot.
SIDE YARD
An open unoccupied space on the same lot between the building and the adjacent side lot line and extending from the front yard to the rear yard.
STORY
That part of a building between any floor and the floor or roof above. Any story under a pitched roof at the top of a building, the floor of which is not more than three feet below the plate shall be counted a half-story when used for rooms, baths or toilets. A basement shall not be counted as a "story," except when occupied for living purposes.
STREET LINE
The dividing line between a street and a lot.
Any nonconforming building or use existing at the effective date of this chapter may be continued. Any existing building designed, arranged, intended or devoted to a nonconforming use at the effective date of this chapter may be reconstructed or structurally altered, provided that the cost of structural alterations to be made in such building shall in no case exceed 30% of its structural value, and further provided that such building shall not be enlarged unless the use therein is changed to a conforming use. No nonconforming use which shall be discontinued for a period exceeding 12 months shall be resumed or replaced with any other nonconforming use. No nonconforming building or use, if once changed to a permitted use, shall ever be changed back to a nonconforming building or use.

For the purposes of this chapter, the Village of South Floral Park is hereby declared to consist of one residential district only.[1]
