No person shall sell or attempt to sell regulated property to a secondhand dealer without the consent of the owner of the property.
No dealer shall sell any article until the same has been in his possession for at least 10 days.
A secondhand dealer shall post a notice outside each point of entry intended for patron use that is substantially similar to that set forth herein:
NOTICE
Don't sell property without the consent of the property's owner. The sale or attempted sale of property to a secondhand dealer without the consent of the property owner is punishable by a civil penalty not to exceed $500 per item plus costs of prosecution; and in default of payment thereof shall be imprisoned for not more than 30 days.
No secondhand dealer or his employees or agents shall purchase or accept on consignment any regulated property from any person under 18 years of age, anyone intoxicated, any person known to be a thief or a receiver of stolen property, or any person that he has reason to believe is a thief or a receiver of stolen property.
Every secondhand dealer must create and maintain a transaction record book as defined in § 165-4 above.
The transaction record book shall be preserved for a period of at least two years from the date of the transaction and must at all reasonable times be open to inspection by officers of the Borough of Marcus Hook Police Department.
