There is hereby created a Public Works Advisory Committee for the City of O'Fallon, Missouri.

A. 
The Public Works Advisory Committee shall consist of two (2) classes of members: citizen members and ex officio members. Ex officio members shall be entitled to attend all meetings and participate in all discussion and debate but shall not have the right to vote.
B. 
There shall be a maximum of twelve (12) citizen members appointed by the Mayor with the consent of a majority of the City Council. All citizen members shall be residents of the City of O'Fallon. Five (5) citizen members shall be appointed such that each ward has one (1) resident representative. Other citizen members shall be appointed at large.
C. 
The ex officio members shall be:
1. 
One (1) member of the City Council selected by the Council.
2. 
The Director of the Public Works Department, or the Director's designee from time to time.
3. 
The City Engineer, or the Engineer's designee from time to time.
4. 
The Director of Water and Sewer operations, or the Director's designee from time to time.
5. 
The Manager of the Environmental Services Department, or the Manager's designee from time to time.
D. 
Except as otherwise provided below, citizen members of the Committee shall hold office for a term of two (2) years. The terms of office for those citizen members initially appointed shall be staggered such that half of the citizen members shall be appointed for an initial term of one (1) year and half of the citizen members shall be appointed for an initial term of two (2) years. Thereafter all citizen members shall be appointed for a term of two (2) years. The City Council member shall serve a term of one (1) year. The Director of Community Development, the City Engineer, Director of Water and Sewer Operations and the Manager of the Environmental Services Division shall serve terms coinciding with such office. Designees of the Director and Traffic Engineer shall serve at the pleasure of the official designating them.
E. 
The terms of all citizen members and the Council member shall expire on April 30 of the appropriate year and when a successor is appointed and qualified.
F. 
Vacancies occasioned by removal, resignation or otherwise, shall be filled in like manner as original appointments and shall be for the balance of the vacant term.
G. 
The citizen members of the Committee shall select one of the citizen members of the Committee as its Chairman. The Chairman shall be appointed for a term of one (1) year to expire on April 30 and when a successor is appointed and duly qualified. The Chairman shall preside at all meetings of the Committee.
H. 
A quorum of the Committee shall consist of a majority of the citizen members.
I. 
The Mayor may, with the consent of a majority of the City Council, remove any citizen or Council Committee member from membership on the Committee at will, and any such member may also be so removed by a two-thirds (2/3) vote of the City Council independently of the Mayor's approval or recommendation.
J. 
No Committee member shall receive compensation for performing the duties of the office.

A. 
Regular meetings of the Committee shall be held monthly. The Committee may meet in special meetings at such additional times as may be set by the Chairman. The Chairman may also cancel a regularly scheduled meeting due to lack of a quorum or business. Meetings cancelled due to lack of a quorum may be rescheduled by the Chairman as necessary.
B. 
All meetings of the Committee shall be open to the public unless otherwise authorized by law.
C. 
The Committee may appoint various of its members as standing or ad hoc subcommittees to address specific matters under consideration by the Committee or to focus on a particular aspect of the Committee's purview, for the purpose of assisting the whole Committee in the discharge of its duties.

A. 
The Public Works Advisory Committee shall have the authority and responsibility to do the following:
1. 
To identify and analyze best practices and innovative approaches in public works, traffic, community development, ecological and environmental protection and enhancement, recycling, green initiatives, and utility matters and advise the Mayor, City Council, City Administrator and Department of Public Works regarding such issues within the City.
2. 
To study, assess and render advice on plans and programs of the City related to the development, construction and maintenance of:
a. 
City buildings and physical facilities;
b. 
Streets and roadways;
c. 
Snow and ice removal plans, programs and equipment;
d. 
Storm water planning, systems and facilities; and
e. 
Water and sanitary sewer systems and facilities owned by or serving the City.
3. 
Identify locations with high accident rates or which pose special dangers or enforcement problems and consider design or regulatory measures which might remedy such problems.
4. 
Serve as a forum to consider citizen suggestions, complaints, concerns or observations relating to city facilities, traffic safety or similar items in the realm of the Public Works Department.
5. 
Consider, evaluate and make recommendations regarding continuation and improvement of City efforts, initiatives, programs, regulations and opportunities relating to ecological and environmental protection and enhancement.
6. 
Consider, evaluate and make recommendations as to policies regarding operation, maintenance and construction of City facilities to further the reduction of greenhouse gases, conserve natural resources, promote renewable resources and encourage recycling.
7. 
Suggest and promote efforts to provide "green" education and outreach programs.
8. 
Consider, evaluate and make recommendations regarding regulations and code requirements pertaining to "green" building design and construction.
9. 
Other matters in support and furtherance of the "green" initiatives contained in the 2015 O'Fallon Comprehensive Plan.
B. 
Nothing contained in this Article shall give the Committee any power, either directly or indirectly, to exercise any authority, direction or control over the Public Works Department or any City Department, Agency, Division or any one or more employees.
C. 
Nothing contained in this Article shall give the Committee the authority to make any changes to any ordinances, policies, practices or procedures of the City. The Committee's role shall be limited to offering such advice and/or insight to the City's elected and appointed officials as it believes would be beneficial to the efficient and effective conduct of the City's activities within the realm of the duties assigned to the Committee above.
