The City will typically give a ten-day
written notice of a violation in the event of an obstruction to the
sight distance, canopy violation or other violation within this Chapter.
If, after the proper notice, no action has been taken, the City, acting
through the Director or his or her designee, may plant, maintain and
remove all vegetation as may be necessary to ensure public safety.
The City will then invoice the property owner in question and if the
invoice is not paid within the required time frame, a lien will be
placed on the property. It shall be a violation of this Section for
any person to interfere with the City's planting, pruning, maintenance
or removal of trees, and a violator shall be subject to a fine of
not more than five hundred dollars ($500.00) for each occurrence and,
in addition thereto, shall be required to replace the trees required
by the Chapter. Violators may be issued a summons to appear in the
Municipal Court for the City of O'Fallon, Missouri. Appeals from a
conviction for violations of this Chapter shall be as provided under
Missouri law to the Circuit Court of St. Charles County, Missouri.
