An itinerant vendor's license shall
be issued solely to not-for-profit organizations that engage in a
temporary or transient business of selling goods, wares, merchandise
or service.

A. Itinerant vendors may be only located as
an accessory use to an existing primary use permitted within the applicable
zoning district and are subject to the following standards:
1.
May not be located within any required
yards or bufferyards;
2.
May not be located within the sight
triangles for any intersections, public or private.
3.
May not reduce the available parking
spaces below what is required for the site through the Zoning Code.
4.
Shall be located upon a hard-surfaced
area.
5.
Are subject to any applicable Building
or Fire Department Codes or regulations.
6.
All signage must be compliant with
the Sign Code and, if necessary, the tent permitting process of the
City of O'Fallon.
7.
May be subject to additional conditions
as deemed necessary to protect the public health, safety and welfare
by the applicable fire district, the O'Fallon Police Department and/or
City of O'Fallon.

A. An applicant for an itinerant vendor's
license shall provide the following to the City:
1.
The name of the not-for-profit organization.
2.
Proof of not-for-profit status.
3.
The permanent home address and telephone
number of the representative filing the request on behalf of the organization.
4.
A brief description of the nature
of the business and the goods sold or service offered and a copy of
any sales flyers.
5.
The place where the goods, wares
or merchandise will be sold.
6.
Such other information as the City
may require.

The duration of an itinerant vendor's
license will be set by the City at time of application. There will
be no fee for said license other than any applicable fees for signage
or tent license.

The not-for-profit organization obtaining
an itinerant vendor's license shall have the license displayed in
a prominent location at the approved site. Said license shall be available
for inspection by any person acting on the City's behalf.

Any person/organization found to
be in violation of any provision of this Chapter shall be subject
to a fine of up to five hundred dollars ($500.00) and each day of
such violation shall constitute a separate offense.
