This Article contains the regulations pertaining to the administration and enforcement of the provisions of this Chapter, issuance of permits and certifications, inspection of property and issuance of stop work, stop use orders and enforcement of violations of the provisions of this Chapter.

A. 
The Plan Commission of the City of Hazelwood, which has been duly created by the City Council, is the City Plan Commission referred to in this Chapter. The City Plan Commission is established to advise the City Council on how best to preserve and protect the existing residential and business community; to provide for, plan, guide and direct the development, redevelopment and growth of the City; to encourage high standards of architectural, site and landscape design; and to encourage public participation.
B. 
Composition, membership, terms of office, compensation, etc. of the City Plan Commission are set forth in Chapter 400 of the City Code. Without limiting such provisions to the City Charter, the City Plan Commission responsibilities, with respect to this Chapter, shall include the following:
1. 
To prepare and adopt a Comprehensive Plan for the physical development of the City or portions thereof and recommend modifications of the same from time to time as deemed in the City's best interest.
2. 
To prepare and submit to the City Council for its approval, a Zoning Ordinance and Zoning Map with such regulations as to the location, height, width, bulk and appearance of buildings and other structures, the use of land and buildings and site improvements for the site of any proposed development or redevelopment of property within the City of Hazelwood, as it shall determine to be necessary or desirable for the promotion of the health, safety and general welfare of the inhabitants of the City.
3. 
To consider and review all requests for rezoning, zoning text amendments, Special Land Use Permits, Planned Districts and Overlay Districts in the manner prescribed elsewhere in this Chapter.
4. 
To prepare and submit reports and recommendations to the City Council on requests for rezoning, zoning text amendments, Special Land Use Permits, Planned Districts and Overlay Districts.
5. 
To recommend to the City Council on its own initiative a petition to amend, supplement, change or repeal this Chapter or any part thereof or recommend amendments to the Zoning Ordinance or Zoning Map as the City Plan Commission determines to be in the City's best interest.
6. 
To develop site development standards, architectural standards and guidelines for new construction, reconstruction or alterations for the purpose of assuring the mutual compatibility of buildings and their surroundings and the appearance, function and permanence of the location, form, shape, massing and exterior materials of building and site improvements.

A. 
The Director of Public Works or his/her designee is designated as the Zoning Enforcement Officer/Administrator of the Zoning Ordinance. The Director of Public Works shall be responsible for the administration and enforcement of the provisions of this Chapter. The powers and duties of the Director of Public Works shall include, but not be limited to, the following:
1. 
Determine compliance with all relevant zoning provisions, standards and conditions of all applications for building permits as provided in this Chapter and other applicable City ordinances.
2. 
Receive, check for compliance with the various submission requirements contained herein and forward to the City Plan Commission all applications for: amendments to the text of this Chapter or to the Zoning Map; Planned Districts; Special Land Use Permits; Overlay Districts; site plan approval; building permits; and variances.
3. 
Maintain permanent and current records pertaining to this Chapter and determinations of the City Plan Commission, Board of Adjustment and City Council relative to this Chapter, including all amendments, variances and Zoning Map changes.
4. 
Forward to the City Plan Commission information and data necessary for performing their functions under provisions of this Chapter.
5. 
Forward to the Board of Adjustment applications for variances, interpretive relief or other matters on which the Board of Adjustment is required to act under this Chapter and perform the duties of Executive Secretary to the Board.
6. 
Enforce all provisions of this Chapter and provide specific notification of violations of this Chapter. If violations are not abated in a reasonable time period as specified, it is the responsibility of the Director of Public Works to document the uncorrected violation and forward said document to the City Attorney for further legal action.
7. 
Review and verify for zoning compliance the use(s) associated with each application for an Occupancy Permit consistent with applicable City ordinances prior to issuance of a business license.
8. 
May cause the cessation of any construction, reconstruction, alteration, conversion, maintenance or use in violation of this Chapter by issuing a stop work or stop use order.

A. 
It shall be the duty of the person designated as the Zoning Enforcement Officer/Administrator to administer and enforce the regulations contained herein.
B. 
It shall be unlawful to commence or to proceed with the construction, reconstruction, conversion, alteration, enlargement, extension, raising or moving of any building or structure, or of any portion thereof, without first having applied in writing to the Director of Public Works for a building permit and the subsequent granting of a building permit.
C. 
Every application for a building permit shall be in writing and delivered to the Director of Public Works and shall be accompanied by a detailed set of plans, in duplicate, showing the size of the proposed building or structure, its location on the lot, the basic materials of which it is to be constructed and the details and type of construction to be used. On the issuance of a permit, one (1) set of said plans shall be retained by the Director of Public Works as a permanent record and one (1) set shall be returned to the applicant.
D. 
Blank forms shall be provided by the Director of Public Works for the use of those applying for permits as provided for in this Chapter. Any permits issued by the Director of Public Works shall be on standard forms for such purpose and furnished by the City.
E. 
A careful record of all such applications, plans and permits shall be kept in the office of the Director of Public Works.
F. 
Any building permit, under which no exterior construction work has been commenced within six (6) months after the date of issue of said permit or under which the proposed interior construction has not been completed within one (1) year of the date of issue, shall expire by limitation and no work or operation shall take place under such permit after such expiration unless an extension is granted in writing by the Director of Public Works.
G. 
Subsequent to the effective date of this Chapter, no change in the use or occupancy of land, nor any change of use or occupancy in an existing building shall be made, nor shall any new building or any existing building structurally altered or changed or converted, in whole or in part, be occupied until a certificate of occupancy has been issued by the Director of Public Works. A change in occupancy shall comprise a:
1. 
Discontinuance of an existing use and the substitution of a use of a different kind or class, and/or
2. 
A change of tenants or proprietors regardless of whether there is or is not a change in use.
Every certificate of occupancy shall state that the new occupancy complies with all provisions of this Chapter. No building or premises shall be occupied until such certificate is issued. A record of all certificates of occupancy shall be kept on file in the Office of the Director of Public Works and copies shall be furnished on request to any person having a proprietary or tenancy interest in land or a building affected by such certificate of occupancy.
