There is hereby established the Economic Development Advisory Commission of the Township of Pohatcong.
The Commission shall consist of one member of the Township Council, one member of the Land Use Board, two members of the general populace, one of which shall be actively engaged in business within the Township and the Mayor or his/her designee. The Commission members shall be appointed for terms of two years, except for the Land Use member, Council member, and the Mayor who shall be appointed annually for one-year terms. There shall be allowed up to two alternate members appointed at large. All members shall be appointed or removed by the Mayor with the advice and consent of the Council.
A. 
The members of the Economic Development Advisory Commission shall choose annually from among its members a Chairman and such other officers as they may deem necessary. The Chairman and other officers shall be chosen at the first meeting of the Commission to be held in January of each year. The Commission shall also select a secretary who may be a member (either regular or alternate) or a municipal employee.
B. 
Alternate members may participate in discussions of the proceeding but may not vote except in the absence or disqualification of a regular member. Four members shall constitute a quorum, and a majority vote of the members present shall determine the outcome of Commission business. An alternate member may be utilized to establish a quorum and, in that event, shall be permitted to vote.
A. 
The Economic Development Advisory Commission shall have the following powers and duties:
(1) 
To inquire into, survey and publicize the extent, advantages and utility of vacant land in the Township which is zoned for commercial or industrial purpose.
(2) 
To recommend to the Township Council the methods of advertising the advantages and opportunities and availability of real estate in the Township for commercial and industrial development.
(3) 
To investigate the availability of state or federal grants which may be available for general community development and particularly for development of commercial and industrial enterprises within the Township.
(4) 
To make such additional studies as may be desirable and necessary to attract commercial or industrial ratables to the Township and to perform such other functions as may be directed from time to time by the Township Council.
(5) 
To provide an annual written report to the Township Council of its activities and recommendations to promote the business and private community of the Township.
(6) 
To attend or have an authorized representative attend and relate the needs of the Township at county and state meetings and functions which relate to the economic welfare and development of the Township.
(7) 
To research and study the Township economics of every nature and to develop, assemble and distribute pertinent information to the Council and the Township Land Use Board to encourage and assist in the comprehensive and orderly economic development of the Township.
(8) 
To promote the economic development of the Township and to establish such programs with the consent of the Township Council for the economic development of the Township.
B. 
The Economic Development Advisory Commission herein established shall not be or be deemed to be an Industrial Commission pursuant to N.J.S.A. 40:55B-1 et seq. and shall not have the powers and authority vested in such a statutory commission or any other power or authority other than those enumerated in this section.
The Economic Development Advisory Commission shall meet at least quarterly and at the call of the Chairman. Meetings shall be open to the public.
A. 
The Township Council shall provide for the Commission in its budget and shall appropriate such funds for the expenses of the Commission as the Township Council, in its sole discretion, shall determine. The Commission shall employ, contract for and fix the compensation of experts and other staff and services as it shall deem necessary, except that the Commission shall obtain legal counsel from the Township Attorney at the rate of compensation determined by the Township Council unless the Township Council, by appropriation, provides for separate legal counsel for the Commission. Expenditures pursuant to this subsection shall not exceed, exclusive of gifts or grants, the amount appropriated by the Township Council for the Commission's use.
B. 
The Commission shall not maintain a separate bank account. All gifts, grants and funds appropriated by the Township Council shall be maintained by the Township's Chief Financial Officer and Auditor. All disbursements shall be vouchered.
