No licensee shall sell, serve, deliver or allow, permit or suffer
the sale, service or delivery of any alcoholic beverage or allow,
permit or suffer the consumption of any alcoholic beverage on the
licensed premises on weekdays between the hours of 2:00 a.m. and 6:00
a.m. and on Sundays between the hours of 2:00 a.m. and 10:00 a.m.,
except that it shall be lawful for the licensed premises to remain
open between the hours of 2:00 a.m. and 6:00 a.m. on New Year’s
Day when it shall fall on a weekday and between the hours of 2:00
a.m. and 10:00 a.m. on New Year's Day when it shall fall on a Sunday.
All the designations hereinabove set forth are intended to mean prevailing
time. The entire licensed premises shall be closed during the hours
in which sale, service, delivery and consumption of alcoholic beverages
are prohibited.
All licenses issued under this chapter shall be subject to the
following further rules, regulations, terms and conditions:
A. No licensee shall sell, serve or deliver nor shall any licensee suffer
the sale, service or delivery of any alcoholic beverage, directly
or indirectly, on or off the licensed premises, to any mental defective,
habitual drunkard or intoxicated person or permit the same in or about
the licensed premises.
B. All licenses granted shall be displayed conspicuously in the licensed
premises.
C. No plenary retail consumption licensee shall allow and/or permit
any employee of the licensed premises to accept any food or beverage,
alcoholic or otherwise, at the expense of or as a gift from any customer
or patron or to sit at any table or stand at any bar with any customer
or patron.

D. No person shall be served in any back room or side room which is
not open to the public generally.
E. The licensee shall maintain a quiet and orderly house and shall not
permit immoral or indecent conduct or behavior within the place so
licensed.
F. A copy of this chapter shall be displayed conspicuously in the licensed
premises.
No licensee shall serve, sell, deliver, or permit or suffer
the service or delivery of any alcoholic beverages, directly or indirectly,
to any person under the age of 21 years or allow, permit or suffer
the consumption of alcoholic beverages by any such person upon the
licensed premises.
It shall be unlawful for any person under the age of 21 years
to consume or to have in his possession any alcoholic beverage in
or upon any public street, highway, avenue, road, alley, park or other
public or quasi-public place within the Borough.
All licensees of premises licensed for the sale or consumption
of alcoholic beverages within the Borough shall post in a conspicuous
place within the licensed premises a notice containing the current
provisions of N.J.S.A. 33:1-81 and 33:1-81.1, the form of which may
be obtained from the Borough Clerk.
No licensee shall allow, permit or suffer in or upon the licensed
premises any disturbances, brawls or unnecessary noises or allow,
permit or suffer the licensed place of business to be conducted in
such a manner as to become a nuisance.
It shall be unlawful for any person to consume or to have in
his possession any open container, bottle, can or receptacle containing
an alcoholic beverage in or upon any public grounds or public lands
within the Borough without a special permit from the governing body.
A. Exception. Lincoln Park Hose Company No. 1 shall be permitted the
right to consume and possess alcoholic beverages within Hose Company
No. 1 building premises subject to the following conditions:
(1) No person under 21 years of age may consume or possess any alcoholic
beverage.
(2) Hose Company No. 1 shall comply with all applicable laws or regulations
concerning the consumption or possession of alcoholic beverages.
(3) The governing body may, by resolution, at any time, suspend permission
for consumption and possession of alcoholic beverages.
(4) Hose Company No. 1 shall provide hold harmless insurance coverage
to the Borough for injuries or damage resulting from the consumption
of alcoholic beverages.
(5) Subject to approval by the State of New Jersey Alcoholic Beverage
Control Commission as may be required by law.
It shall be unlawful for any person to sell, serve or deliver
or suffer the sale, service or delivery of any alcoholic beverages
in or upon any public grounds or public lands within the Borough without
a special permit from the Alcoholic Beverage Control Commission and
the governing body.
Any person violating any of the provisions of §§
163-7 and
163-8 shall, upon conviction thereof, be subject to a penalty as provided in §
1-2 of this Code.
