There is established and organized a Police Department to consist
of a Chief of Police and as many other Police Officers, regular or
probationary, as the City Manager may deem necessary.

A. For
the purpose of this Section, the "Major Case Squad" shall mean any formation, operation, organization or cooperative
action between any County, Governing Body, any municipal government
and the City of Richmond Heights, the purpose of which is intensive
professional investigation of certain individual crimes that may occur
in the general geographic area, and which is operated and activated
on request of a County Sheriff, County Police Chief or the Police
Chief of a political subdivision wherein a crime has occurred.
B. For
the purpose of this Section, the "Multijurisdictional Task
Force" shall mean any formation, operation, organization
or cooperative action between any municipal government and the City
of Richmond Heights, the purpose of which is intensive professional
investigation of narcotic and drug-related crimes that may occur in
the general geographical area, and which is operated and activated
on request of the Police Chiefs of the respective political subdivisions
wherein the crimes have occurred and who constitute members of the
Multijurisdictional Task Force or other mutual-aid agreement.
C. The
City of Richmond Heights may contract and agree to cooperate with
each and every city, town and village within the County and with the
City of St. Louis, Missouri, for common Police service and mutual-aid
including, but not limited to, the Major Case Squad and Multijurisdictional
Task Force. Such agreements shall become effective with respect to
each municipality upon the adoption of a like ordinance by the legislative
body of such municipality.
D. The
officers of the City of Richmond Heights Police Department are authorized
to participate in and cooperate with any Law Enforcement Officers
of jurisdictions in the Major Case Squad or Multijurisdictional Task
Force operation or formation. The Police Officers designated to act
in the Major Case Squad operation or Multijurisdictional Task Force
operation will be so designated by the Chief of Police and when acting
outside of the City of Richmond Heights as a member of the Major Case
Squad operation or Multijurisdictional Task Force operation shall
be considered to be on active duty the same as if acting within the
boundaries of the City of Richmond Heights.
E. Whenever
any Police Officer is duly authorized as a member of the Major Case
Squad or the Multijurisdictional Task Force or other mutual-aid agreement,
he/she shall have the power to arrest anywhere within this State.
This power shall be exercised only during the time the Police Officer
is an active member of an active Major Case Squad or Multijurisdictional
Task Force, and only within the scope of the investigation on which
the Squad or Group is working.
F. The
officers of the City of Richmond Heights Police Department who have
completed the basic Police training program as promulgated by Chapter
590 of the Revised Statutes of Missouri are authorized to respond
to any emergency situation outside the boundaries of Richmond Heights.
The officers responding will be so designated by the Chief of Police
when acting outside of the City of Richmond Heights and when acting
on their regular duties within the City of Richmond Heights.
G. For
the purposes of this Section, the term "emergency situation" means any situation in which a Law Enforcement Officer has reasonable
belief that a crime is about to be committed, is being committed or
has been committed involving injury or threat of injury to any person,
property or government interest and the officer's response is reasonably
necessary to prevent or end such emergency situation or mitigate the
likelihood of injury involved in such emergency situation. The determination
of the existence of any emergency situation shall be in the discretion
of the officer making the response or in the discretion of an officer
or governmental officer of the political subdivision in which the
emergency situation is alleged to be occurring.
H. Any
City of Richmond Heights Police Officer responding to an emergency
situation, pursuant to the provisions of this Section, has the same
immunities and liabilities as if acting within the jurisdictional
boundaries of the City of Richmond Heights. Officers providing police
services in another jurisdiction pursuant to such an agreement shall
have the same powers of arrest as officers of the requesting political
subdivision, and shall have the same immunity as if acting within
their own jurisdiction.

A. The
City of Richmond Heights, Missouri, hereby agrees to cooperate with
the City of St. Louis, Missouri, St. Louis County, Missouri, and with
each and every City, Town and Village within St. Louis County, Missouri,
and St. Charles, Franklin and Jefferson County, Missouri, for certain
common Police services under the terms and conditions hereinafter
set forth. This contract shall become effective with respect to each
such municipality or County upon the passage of a like ordinance by
the legislative body of such municipality or County.
B. The
members of the Police force of the City of Richmond Heights shall
respond, if consistent with the public safety of the City of Richmond
Heights, to requests for assistance within the boundary limits or
any other cooperating municipality or County, pursuant to the directions
and regulations provided by the office of the Chief of Police of the
City of Richmond Heights.
C. Each
Richmond Heights Police Officer performing services in any other municipality
or County in accordance with the terms of this contract shall have
all of the powers, rights, privileges, duties and immunities as the
members of the Police force of the municipality or County requesting
assistance, but shall remain in the employment and under the direction,
supervision and control of the office of the Police Chief of the City
of Richmond Heights, Missouri.
D. The
consideration for this agreement shall be the mutual agreements of
the parties hereto for the services to be given for the protection
of lives and property by the Police Department of each participating
municipality or County and no compensation shall accrue or be paid
by any participating municipality or County to any other.
E. Equipment
and property utilized in the carrying out of the common Police service
provided by this agreement shall be at the risk of the municipality
or County owning same and any loss or damage thereto shall be borne
by such owner-municipality; provided that nothing herein contained
shall be construed to limit the liability of any municipality or County
or its agents, servants or employees arising out of its or their negligence
or tortious conduct. Notwithstanding anything to be contrary stated
herein, sovereign immunity shall not be waived for any conduct or
event occurring under the terms of this agreement.
F. No
municipality or County participating in this agreement shall be liable
to any other for failure to respond to any call by the other, or for
delay or negligence or mistake in receiving or responding to any call,
nor shall this agreement be interpreted as being an agreement for
the benefit of any third (3rd) person.
G. Nothing
herein contained shall be construed to mean that a Police Officer
of any other municipality or County participating in this agreement
who is injured, or who dies of injuries sustained while performing
services in the City of Richmond Heights under this agreement, shall
be covered by any insurance provided by the City of Richmond Heights
for its Police Officers.
H. No
Police Officer of the City of Richmond Heights otherwise entitled
to the benefits and protection of any insurance carried by the City
of Richmond Heights shall be deprived thereof by reason of the fact
that such officer was injured or death occurred as a result of injuries
sustained in another municipality, provided that any such injury or
death occurred while such officer was performing services pursuant
to this agreement.
I. This
agreement, insofar as it is applicable to any particular municipality,
may be terminated at any time by any party hereto thirty (30) days
after service upon the Clerk of each remaining contracting municipality
of a certified copy of an ordinance terminating the agreement of such
municipality.

A. Unless
otherwise required by State law all property seized and held for evidence,
after final disposition of the cause in which such property was used
as evidence, and all lost property in the possession of the Police
Department which is of such nature that its possession or sale is
unlawful, shall be destroyed under the supervision of the Chief of
Police. If lost property in the possession of the Police Department
is not claimed by its rightful owner within a period of ninety (90)
days or if property seized or held is proven to be stolen property
and the owner is unknown or the owner does not claim such property
within thirty (30) days after the disposition of the cause in which
the property has been used as evidence, then such property shall be
sold under the supervision of the Chief of Police, provided that the
possession or sale of such property is lawful.
1. Sales shall be held at public auction periodically and from time
to time as may be determined by the Chief of Police, and a notice
thereof containing a general description of the articles to be sold
shall be published in a local community newspaper.
2. All proceeds of sales less actual expense of the sales including
the costs of publication shall be deposited in the General Revenue
Fund of the City.

The Chief of Police shall keep all money or property coming
into his/her hands as a consequence of the arrest of a person charged
with a crime or misdemeanor. He/she shall report his/her possession
to the Municipal Judge who shall determine the method of disposing
of such money or property.
