A. Distance From Property Lines. No blasting, quarrying, mining
and/or extraction of mineral operation shall be carried on or any
stock pile placed closer than one hundred (100) feet to any property
line.
B. Distance From Public Right-Of-Way. In the event that the
blasting, quarrying, mining and/or extraction of mineral operation
is adjacent to the right-of-way of any public street or road, no part
of such operation shall take place closer than one hundred (100) feet
to the nearest line of such right-of-way.
C. Distance From Public Utilities. No quarrying, mining and/or
extraction of mineral operation shall be carried on closer than one
thousand (1,000) feet to any public utility easement.
D. Fencing. Fencing shall be erected and maintained around
the entire site or portions thereof where, in the opinion of the Board
of Aldermen or its designee, such fencing is necessary for the protection
of the public safety.
E. Equipment. All equipment and machinery shall be operated
and maintained in such manner as to minimize dust, noise and vibration.
Access roads shall be maintained in dust-free condition by surfacing
or other treatment as may be specified by the Board of Aldermen or
its designee.
F. Processing. The crushing, washing and refining or other
similar processing may be an accessory use, provided however, that
such accessory processing shall not be in conflict with the use or
zoning regulations in which the operation is located.

All motor vehicles and every trailer and semi-trailer operating
upon the public streets of the City of Peculiar, Missouri, and carrying
goods or material or farm products which may be reasonably expected
to become dislodged and fall from the vehicle, trailer or semi-trailer
as a result of wind pressure or air pressure and/or by the movement
of the vehicle, trailer or semitrailer shall have a protective cover
or be sufficiently secured so that no portion of such goods or material
can become dislodged and fall from the vehicle, trailer or semi-trailer
while being transported or carried.

A. The
operation between the hours of 6:00 P.M. and 6:00 A.M. Monday through
Friday; 2:00 P.M. and 7:00 A.M. on Saturday; and on Sunday, New Year's
Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving and Christmas
of any equipment which is used in the blasting, quarrying, mining
and/or extraction of minerals of any rock, mineral or ore or any equipment
to prepare, finish or wash any rock, mineral or ore is hereby declared
to be a public nuisance and is unlawful.
B. Blasting
in conjunction with any above ground or below surface quarrying, mining
and/or extraction of minerals operation between the hours of 5:00
P.M. and 8:00 A.M. Monday through Friday; and on Saturday, Sunday,
New Year's Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving
and Christmas is hereby declared to be a public nuisance and is unlawful.
C. Violation
of this Section shall be punished as a misdemeanor.
