The monthly rates charged and collected by the City of Peculiar, Missouri, for waterworks service furnished by the waterworks system of the City of Peculiar, Missouri, shall be approved by the Board of Aldermen, set forth in the City's annual budget and adjusted as necessary through budget amendments. A Schedule of Utility Rates is available at City Hall.

The Board of Aldermen of the City of Peculiar, Missouri, hereby binds and determines that the rates, fees, and charges for the use and services of the waterworks system of the City of Peculiar, Missouri, are necessary and adequate at this time to meet the requirements of the Revised Statutes of Missouri.

A. 
Application for water services shall be made to the Clerk or his/her designee by the service user and/or property owner. Each application shall be reviewed by the Development Service Director and/or Codes Enforcement Officer. Connection fees shall be assessed on a per-unit basis and in accordance with Subsection (D) of Peculiar Municipal Code Section 700.010. Connection fees shall be paid by the applicant at the time the application is filed but, in any case, no water connection fees may be tendered in advance of a building permit. The term "unit" as used in this Section refers to a structure used for residential, commercial, and/or industrial occupation or use, even when located in a multi-unit complex. Upon approval of the application for water services, the applicant shall have the right to connect with the City of Peculiar's water system.
B. 
Monies collected from water tap connection fees will be deposited directly into the Water Fund's operating account located at the City's approved financial banking institution. Water tap connection fees will be recorded within their own revenue account on the City's General Ledger.
C. 
In making water connections, the City of Peculiar, Missouri, will be responsible for making the water tap to the main line, furnishing the meter and the meter well with their necessary parts and materials.
D. 
In completing the water connection, the customer or applicant will be responsible for the water line materials and labor from the water tap, including setting the meter well, to the residence or building site as specified by City requirements.
E. 
Individual water meters of the appropriate size must be installed for individual businesses located in multi-tenant business centers.
F. 
Individual water meters of the appropriate size must be installed for individual living units located in multi-tenant residences, which shall include "R-2" and "R-3" zoned housing.
G. 
There shall be one (1) water connection for each unit in all applications.

The City of Peculiar, Missouri, shall not be liable for any damage of any water service customer caused by termination of service due to delinquency of payment by a customer.

No free water service shall be furnished to any premises, or the owner or occupant thereof, except to the City of Peculiar, Missouri, itself, and in the event that the revenues derived by the City of Peculiar, Missouri, from the waterworks system shall at any time prove insufficient to pay the interest on and principal of the waterworks system revenue bonds of the City of Peculiar, Missouri, issued to construct, extend, or improve such system or any parts thereof, and to establish and maintain reasonable reserves as provided in the ordinance authorizing the issuance of such bonds, then the City of Peculiar, Missouri, will thereafter pay a fair and reasonable charge for all waterworks services furnished the City of Peculiar, Missouri, or any of its departments by the waterworks system, and such payments will continue so long as the same may be necessary in order to prevent any default in the payment of the interest on or principal of the waterworks system revenue bonds of the City of Peculiar, Missouri, or while any such default shall exist.

A. 
It shall be a misdemeanor for any person to tamper with any water line, water main, water meter, or to make any connection to the waterworks system for the City of Peculiar, Missouri, without written permission from the City Development Services Director, or to reconnect service when service has been discontinued for non-payment of a bill for service until such bill, including the administrative fee/reconnection charge, has been paid in full. Upon conviction, there shall be imposed a fine of not less than fifty dollars ($50.00), nor more than five hundred dollars ($500.00).
B. 
It shall be a direct violation of this Section for a person to tamper with any water line, water main, water meter, or to make any connection to the waterworks system for the City of Peculiar, Missouri, without written permission from the City Development Services Director; or to reconnect service after discontinuation for non-payment until the account's balance (including administrative fee/reconnection charges) has been paid in full. In the event that water service is disconnected due to non-payment and no application has been made to restore service, the Utility Department shall be responsible for determining whether service has been restored by any means other than the City of Peculiar Utility Department. The primary means of making this determination shall be through daily inspections of the meter after disconnection of service. If the meter indicates that usage has occurred since termination, the meter shall be removed immediately. Replacement of the meter shall require the property owner and/or services user to remit payment, prior to the restoration of service, of one hundred dollars ($100.00), the outstanding account balance, and service administrative fees.

A. 
The user of each premises receiving water service from the waterworks system shall be held responsible for the proper use thereof.
B. 
Plumbing facilities that are to be connected to the waterworks system shall be installed in accordance with the Uniform Plumbing Code, and shall be inspected for compliance with said Code by a designated representative of the City of Peculiar, Missouri, before any such connection is made.
C. 
The service user and/or property owner of each water utility premises shall be held responsible for all damages, whether intentionally or unintentionally inflicted, to City-owned waterworks equipment within the City's utility right-of-way. For the purposes of this Section, this equipment includes, but is not limited to, the following: water meter lids, water valve lids, transponders, transponder wiring, and all other materials contained inside the water meter lids. If, upon inspection by the City of Peculiar Water Department, damage is found, the City may seek reimbursement for any and all damages, including parts and necessary labor for reinstallation and/or repair of the damaged equipment. Pricing for the parts and labor costs shall be assessed in accordance with the City's price schedule which shall be available at City Hall (250 South Main Street, Peculiar, Missouri 64078).
D. 
The City of Peculiar shall be responsible for the maintenance and repair of City-owned utilities in the form of water mains, water main valves, water service lines, and City-owned water meters through the output side[1] of said water meter/s which are located within the City's right-of-way, and/or easements which are granted to the City. The property owner shall be responsible for the maintenance and repair of any and all water service lines from the output side of the City-owned water meter/s which are located within the City's right-of-way, and/or easements which are granted to the City to and including any of the plumbing within the structure being served.

E. 
The City shall not be liable for any damages or repairs to any water service line outside of the City's right-of-way, and/or easements which are granted to the City, nor shall the City be liable for any damages caused by a faulty/damaged water meter outside of the City's right-of-way and/or easements which are granted to the City.

F. 
Public Works field crew staff shall at all reasonable hours[2] have free access to all parts of any building, dwelling house or premises of any kind to which service is furnished for the purpose of installing, examining, repairing or removing any meters or other material or appliances belonging to the City; to read meters; turn on or disconnect service; or for any other purpose that may be deemed essential for the preservation of such property, prevention of waste or collection of revenue.
