The Mayor of the City is hereby authorized to declare an emergency
situation when there becomes a distinct possibility of water distribution
shortage within the City and is authorized to implement such stages
as may be necessary to protect the water system of the City of Peculiar,
Missouri. The emergency situation will remain in force until such
time as the Mayor shall determine that it is no longer necessary to
be in force.

A. That
after an emergency situation is declared, the following stages may
be enacted by the Mayor:
1. STAGE 1: Request voluntary conservation and compliance
with the following restrictions:
a. No washing of sidewalks, driveways, parking areas, patios, or other
paved areas.
b. No washing of cars or other motor vehicles, trailers or boats.
c. No water is to be used for dust control.
d. No flushing of mains except to alleviate specific complaints.
e. All users to conserve water as much as possible.

If after the initiation of Stage 1, weather conditions, expected
trends in demand or other factors indicate that this water shortage
will continue, or at the same time that Stage 1 is declared, the additional
provisions of Stage 2 may be implemented:

2. STAGE 2: All restrictions listed in Stage 1 are
now mandatory along with the following mandatory restrictions:
a. No use of water from a fire hydrant except for fighting fires.
b. Watering of lawns, gardens, trees, or other plants is prohibited
except from a hand held container.
c. Water from the water hauling system is to be for household use only
and not for any outside use.
d. Service may be cut off to any person, firm or corporation that permits
a leak to exist in their water service line so as to waste water unnecessarily.
e. No refilling of swimming pools with water furnished by the City.
3. STAGE 3: All restrictions listed in Stage 1 and
2 are mandatory.
a. All commercial car washes will cease operation until Stage 3 is downgraded
or canceled.
b. Water hauling station will be closed until Stage 3 is downgraded
or canceled.
B. The
uses of the water herein restricted and regulated shall apply only
to the water purchases from the Municipal water system.

It is hereby declared that each violation of this Article shall
be deemed a separate offense. First (1st) time offenders shall receive
a written warning. Second (2nd) time violators shall be punished upon
conviction thereof or a plea of guilty thereto by a fine of not less
than one hundred dollars ($100.00) nor more than five hundred dollars
($500.00) and in addition thereto, as a part of said judgment, the
Judge of the Municipal Court, may order and adjudge the public nuisance
to be abated at the cost of the owner. Upon any third (3rd) conviction
thereof, the City of Peculiar may cause the City's supply of water
to the premises where the violation occurred to be restricted in volume
or shut off until the emergency is over. The findings of the Superintendent
of the Water Department that a violation exists shall be final and
conclusive upon all parties concerned and he shall make such findings
by giving such violator written notice of such violation and notice
to cease and desist immediately.
