The Chief of Police shall be appointed from time to time by
the Mayor with the consent and approval of a majority of the City
Council.

A. The
Chief of Police may promote, demote or suspend any member of the Police
Department and he/she may recommend the promotion and/or termination
of any member of the Police Department. In the event that the Chief
of Police wishes to promote, demote or suspend or recommend the termination
of any member of the Police Department, he/she shall conduct such
investigation as he/she shall deem appropriate with respect to the
proposed action and shall present the matter, along with his/her recommendation,
to the City Council at their next regular or special meeting. Provided
however, that the Chief of Police shall have the authority to suspend
any member of the Police Department with or without pay for a period
of time not to exceed seventy-two (72) hours without notifying or
obtaining the approval of the City Council and to issue and record
verbal or written reprimands, in his/her sole discretion, to any member
of the Police Department.
B. Nothing
in this Section is intended to abrogate the power of the Mayor and
City Council to promote, demote, suspend, discipline or terminate
the appointment of the Chief of Police and/or any Police Officer at
will as granted to the Mayor and City Council by the laws of the State
of Missouri.

A. The
Police Department of the City of Breckenridge Hills shall keep true
and complete records of all weapons, intoxicating liquor and all other
property of any kind or description which comes into its possession
during the course of its operations and such records shall contain
a description of the item, the date on which the department took possession
of said item, from whom taken or where found, date of disposal, method
of disposal and to whom delivered and the amount received from the
sale thereof, if any.
B. The
Chief of Police, with the approval of the majority of the members
of the City Council, is hereby authorized to dispose of such property
in the following manner:
When same has been in the possession of the Police Department
for more than one (1) year without being returned to the owner thereof
and when no other procedure for disposal of same is provided for by
the laws of the State of Missouri, the following procedure shall be
used:
1. Property known and classified as weapons, including, but not limited
to, knives, pistols, shotguns, rifles, clubs and chains, shall be
destroyed.
2. Property known and classified as intoxicating liquor shall be destroyed.
3. All property commonly known as drugs of any kind and description
shall be destroyed.
4. All other property shall be sold at a public auction advertised one
(1) time in a newspaper of general circulation in the City at least
one (1) week prior to the date of such auction. The Police Department
shall obtain from each person purchasing any item at such auction
a receipt for such item or items, the amount paid for each item and
the name and address of the purchaser of each item.
C. The proceeds from any sale provided for in Subsection
(B) of this Section shall be deposited in the General Revenue Fund of the City of Breckenridge Hills, Missouri.

A. Peace
Officers of the City of Breckenridge Hills Police Department are authorized
to participate in and cooperate with any Law Enforcement officers
of jurisdictions in any Major Case Squad operation or formation. The
officers designated to act as the Major Case Squad operation will
so be designated by the Chief of Police and, when acting outside the
City of Breckenridge Hills as a member of the Major Case Squad operations,
shall be considered to be on active duty, the same as he/she is acting
within the boundaries of the City of Breckenridge Hills. This power
shall only be exercised during the time the Peace Officer is an active
member of an active Major Case Squad and only within the scope of
the investigation on which the Squad is working.
B. The
Major Case Squad may operate within the City of Breckenridge Hills
on the request of the Chief of Police.
