A. The International Fire Code as adopted by Section
500.070.
B. There
shall be not less than three (3) copies of said International Fire
Code on file with the City of Richmond, Missouri.
C. The
provisions of this Section shall not be construed to relieve from
responsibility or to lessen the responsibility of any person to which
said Code makes reference, nor shall the City, its officers, agents
and employees be held as assuming any liability of any nature by reason
of the adoption of said Code.

A. The
International Fire Code shall be enforced by the Bureau of Fire Prevention
in the Fire Department of the City of Richmond, Missouri, which is
hereby established and which shall be operated under the supervision
of the Chief of the Fire Department.
B. The
Chief in charge of the Bureau of Fire Prevention shall be designated
by the Fire Chief and may be the Fire Chief himself/herself if he/she
is so designated.
C. The
Chief of the Fire Department may detail such members of the Fire Department
as inspectors as shall from time to time be necessary. The Chief of
the Fire Department shall recommend to the City Council and Mayor
the employment of technical inspectors who, when such authorization
is made, shall be selected for a particular purpose.

Whenever the Chief disapproves an application or refuses to
grant a permit applied for, or when it is claimed that the provisions
of the Code do not apply or that the true intent and meaning of the
Code have been misconstrued or wrongly interpreted, the applicant
may appeal from the decision of the Chief to the City Council of the
City of Richmond, Missouri, in writing within thirty (30) days of
the date of the decision appealed. Said appeal must be placed with
and filed with the office of the City Clerk and the reasons of the
appellant why the Code has been misconstrued or wrongly interpreted
must be in writing with specificity.

The Mayor, the Chief and the Fire Committee of the City of Richmond
and City Council shall act as a committee to determine and specify,
after giving affected persons an opportunity to be heard, any new
materials, processes or occupancies for which permits are required
in addition to those now enumerated in said Code. The Chief of the
Bureau of Fire Prevention shall post such list in a conspicuous place
in his/her office and distribute copies thereof to interested persons.

A. Any
person who shall violate any of the provisions of this Code or standards
hereby adopted or fail to comply therewith, or who shall violate or
fail to comply with any order made thereunder, or who shall build
in violation of any detailed statement of specifications or plans
submitted and approved thereunder, or any certificate or permit issued
thereunder, and from which no appeal has been taken, or who shall
fail to comply with such an order as affirmed or modified by the City
Council or by a court of competent jurisdiction, within the time fixed
herein, shall severally for each and every such violation and non-compliance,
respectively, be guilty of an ordinance violation punishable by a
fine of not less than one dollar ($1.00) nor more than five hundred
dollars ($500.00) or by imprisonment for not less than one (1) day
nor more than one hundred eighty (180) days, or by such fine and imprisonment.
The imposition of one (1) penalty for any violation shall not excuse
the violation or permit it to continue; and all such persons shall
be required to correct or remedy such violations or defects within
a reasonable time; and when not otherwise specified, each day that
prohibited conditions are maintained shall constitute a separate offense.
B. The
application of the above penalty shall not be held to prevent the
enforced removal of prohibited conditions. In the event the City of
Richmond must obtain a court order to remove prohibited conditions,
the City of Richmond is entitled to all of its damages, costs and
legal fees.

The provisions of the International Fire Code and the International
Fire Code Standards adopted by this ordinance (Ordinance No. 1216)
shall not be construed to relieve from responsibility or to lessen
the responsibility of any person liable under the provisions of such
Code, nor shall the City, its officers, agents and employees be held
as assuming any liability of any nature by reason of the inspection
authority issued to the appropriate parties for inspections made pursuant
to such ordinance and Code.
