A.
Any person violating any provision of this chapter may be penalized
by the initiation of criminal proceedings, in which case the penalties
shall be as provided in MGL c. 130.
B.
As an alternative to the initiation of criminal proceedings, any
person violating any provision of this chapter may be penalized as
provided by MGL c. 40, § 21D, which provides for noncriminal
disposition of said violations. The penalty therefor shall be $50
for a first violation, $100 for a second violation and $200 for a
third and subsequent violations.
